HLS 14RS-1259 ORIGINAL Page 1 of 2 Regular Session, 2014 HOUSE CONCURRENT RESOLUTI ON NO. 38 BY REPRESENTATIVE HOLLIS CONGRESS: Urges Louisiana's congressional delegation to support a national moratorium on the Patient Protection and Affordable Care Act A CONCURRENT RESOLUTI ON1 To urge and request the Louisiana congressional delegation to support a national moratorium2 on implementation and enforcement of the Patient Protection and Affordable Care3 Act for a period of at least three years.4 WHEREAS, the separation of powers between the branches of the federal5 government and between federal and state authority is essential to the preservation of6 individual liberty; and7 WHEREAS, the Constitution of the United States creates a federal government with8 limited, enumerated powers, and reserves to the states or to the people those powers not9 granted to the federal government; and10 WHEREAS, with respect to health care, the United States Congress has enacted laws11 that preempt the laws of states and place an increasing strain on state budgets, in turn12 impeding the ability of states to meet other critical responsibilities such as those relative to13 education, infrastructure, and public safety; and14 WHEREAS, it is the public policy of Louisiana to protect individual liberty and15 personal control over healthcare decisions; and16 WHEREAS, in furtherance of this policy of protecting individual liberty, the17 Legislature of Louisiana hereby declares that regulatory authority over health care should18 be vested in the states; and19 HLS 14RS-1259 ORIGINAL HCR NO. 38 Page 2 of 2 WHEREAS, federal directives that compel Louisiana agencies, officers, or state1 employees to aid in the implementation or enforcement of the provisions of the Patient2 Protection and Affordable Care Act of 2010, inclusive of any amendments thereto, are in3 direct conflict with the public policy of this state.4 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby5 urge and request the Louisiana congressional delegation to support a national moratorium6 on implementation and enforcement of the Patient Protection and Affordable Care Act for7 a period of at least three years.8 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the9 presiding officers of the Senate and the House of Representatives of the Congress of the10 United States of America and to each member of the Louisiana congressional delegation.11 DIGEST The digest printed below was prepared by House Legislative Services.
