HLS 14RS-1396 ORIGINAL Page 1 of 2 Regular Session, 2014 HOUSE CONCURRENT RESOLUTI ON NO. 4 BY REPRESENTATIVE ORTEGO SANITARY CODE: Repeals provision of the sanitary code relative to solar water heating systems A CONCURRENT RESOLUTI ON1 To repeal the Department of Health and Hospitals, office of public health rule, LAC2 51:XIV.513, which provides for requirements for solar water heating systems; and3 to direct the Office of the State Register to print the repeal in the Louisiana4 Administrative Code.5 WHEREAS, attaining independence from our detrimental reliance on fossil fuels6 should be a long standing objective for the state; and7 WHEREAS, solar water heating systems reduce carbon dioxide emissions equivalent8 to a small family car's yearly running; and9 WHEREAS, a solar water heating system can be retrofitted to community buildings10 with the minimum of fuss and the systems will make virtually no noise while in operation;11 and 12 WHEREAS, the Department of Health and Hospitals, office of public health rule,13 LAC 51:XIV.513, places an undue burden on persons who wish to install solar water heating14 systems; and15 WHEREAS, the installation requirements are cumbersome and unnecessary as the16 solar water heating system is a closed system; and17 WHEREAS, R.S. 49:969 provides that "the legislature, by concurrent resolution, may18 suspend, amend, or repeal any rule or regulation or body of rules or regulations adopted by19 a state department, agency, board, or commission".20 HLS 14RS-1396 ORIGINAL HCR NO. 4 Page 2 of 2 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby1 repeal LAC 51:XIV.513.2 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the3 Office of the State Register.4 BE IT FURTHER RESOLVED that the Office of the State Register is hereby5 directed to have the repeal of LAC 51:XIV.513 printed and incorporated into the Louisiana6 Administrative Code.7 DIGEST The digest printed below was prepared by House Legislative Services.
