Regular Session, 2014 HOUSE CONCURRENT RESOLUTI ON NO. 46 BY REPRESENTATIVE NORTON TEACHERS: Amends a State Board of Elementary and Secondary Education rule relative to planning time for teachers A CONCURRENT RESOLUTI ON1 To amend the State Board of Elementary and Secondary Education rule (LAC2 28:CXV.911(A)), relative to planning time and lunch periods for teachers, and to3 direct the Office of the State Register to print the amendment in the Louisiana4 Administrative Code.5 WHEREAS, relative to planning time for teachers, LAC 28:CXV.911(A) provides6 for a minimum of forty-five minutes of daily planning time or its weekly equivalent each day7 for every teacher actively engaged in the instruction and supervision of students in the public8 schools and provides that implementation of such planning time is subject to the availability9 of state funds and shall not result in a lengthened school day; and10 WHEREAS, there is some concern that the rule adopted by the State Board of11 Elementary and Secondary Education needs to be amended to specify the types of activities12 that such planning time may and may not include; and13 WHEREAS, R.S. 49:969 provides that the "legislature, by Concurrent Resolution,14 may suspend, amend, or repeal any rule or regulation or body of rules or regulations, or any15 fee or any increase, decrease, or repeal of any fee, adopted by a state department, agency,16 board, or commission".17 THEREFORE, BE IT RESOLVED by the Legislature of Louisiana that LAC18 28:CXV.911(A) is hereby amended to read as follows:19 ยง911. Planning Time and Lunch Periods20 A. Implementation of planning time and lunch periods for teachers as required3 in this Section shall not result in a lengthened school day. Planning includes but is4 not limited to preparation for instruction, evaluation of student work, and completion5 of administrative functions related to instruction. Time spent attending6 administrative meetings or training at which attendance is required by school7 administrators shall not be counted toward the daily minimum of planning time to8 which teachers are entitled.9 * * *10 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the11 Office of the State Register, the president of the State Board of Elementary and Secondary12 Education, and the state superintendent of education.13 BE IT FURTHER RESOLVED that the Office of the State Register is hereby14 directed to have the amendment to the rule printed and incorporated into the Louisiana15 Administrative Code and to transmit a copy of the revised rule to the president of the State16 Board of Elementary and Secondary Education and the state superintendent of education.17 DIGEST The digest printed below was prepared by House Legislative Services.
