ENROLLED Page 1 of 2 Regular Session, 2014 HOUSE RESOLUTION NO. 161 BY REPRESENTATIVE ST. GERMAIN A RESOLUTION To urge and request the Louisiana Public Service Commission to review the rules and regulations relative to wreckers and towing services to ensure wrecker and towing practices are fair and equitable and submit a report before March 1, 2015, to the House Committee on Commerce of its findings and of any proposed rules and regulations to be considered by the Louisiana Public Service Commission. WHEREAS, the Louisiana Public Service Commission (commission), pursuant to R.S. 45:180.1, has the power and authority necessary to supervise, govern, regulate, and control the business of the operation and use of wreckers and towing services, to designate classes and categories of such vehicles, to fix reasonable and just rates, fares, tolls, charges for storage services, or charges for the commodities furnished or services rendered by persons engaging in the operation and use of such vehicles; and WHEREAS, no person shall engage in the business of operating and using wreckers and towing services without first having obtained from the commission a wrecker license; and WHEREAS, R.S. 32:1736 provides that all fees charged by a tow truck operator for the nonconsensual towing of a vehicle from private property or parking areas shall be uniform and shall be set in accordance with rules and regulations adopted by the commission; and WHEREAS, there are towing and recovery charges, other towing, equipment, and manpower charges, storage charges, and fuel surcharges for the towing of vehicles and such charges create a financial hardship, especially for college students; and WHEREAS, the hours of operation of a wrecker and towing company's storage facility and a cash-only payment method create additional hardships for a person when his vehicle is towed; and ENROLLEDHR NO. 161 Page 2 of 2 WHEREAS, wreckers and towing services are regulated by the Louisiana Public Service Commission and such practices and rules and regulations need to be reviewed periodically and amended to ensure wrecker and towing services are fair and equitable. THEREFORE, BE IT RESOLVED that the House of Representatives of the Legislature of Louisiana does hereby urge and request the Louisiana Public Service Commission to review the rules and regulations relative to wreckers and towing services to ensure that the practices are fair and equitable and submit a report before March 1, 2015, to the House Committee on Commerce of its findings and of any proposed rules and regulations to be considered by the Louisiana Public Service Commission.
