HLS 14RS-5560 ORIGINAL Page 1 of 2 Regular Session, 2014 HOUSE STUDY REQUEST NO. 3 BY REPRESENTATIVE LEGER CLERKS OF COURT: Requests the House Judiciary Committee to study funding relative to the clerk of court for the Criminal District Court for the parish of Orleans A STUDY REQUEST1 To the House Committee on Judiciary to study funding for the offices of the clerk for the2 Criminal District Court for the parish of Orleans in accordance with state laws, to3 determine if there is an alternate funding source available to supplement the clerk's4 budget, and to report its findings to the House of Representatives prior to the5 convening of the 2015 Regular Session of the Legislature of Louisiana.6 WHEREAS, Louisiana laws require the city of New Orleans to fund certain expenses7 relative to the offices of the clerk for the Criminal District Court for the parish of Orleans;8 and9 WHEREAS, Act No. 229 of the 2013 Regular Session of the Legislature provides10 that state statutes mandating payment by the city to the state's employees and officers of the11 clerk constitute a valid exercise of state's police power and do not violate the Louisiana12 Constitution of 1921 or the Louisiana Constitution of 1974; and 13 WHEREAS, the amounts required to be paid by the city of New Orleans for14 expenses, including salaries of constitutional officers, their deputies, subordinates, and15 employees, to adequately fund the office of the clerk of the Criminal District Court for the16 parish of Orleans are necessary for the efficient performance of the powers and duties17 required of a judicial officer of the state. 18 THEREFORE, the House of Representatives of the Legislature of Louisiana requests19 the House Committee on Judiciary to study the process by which the offices of the clerk for20 the Criminal District Court for the parish of Orleans is being funded, to determine if there21 HLS 14RS-5560 ORIGINAL HSR NO. 3 Page 2 of 2 is an alternate funding source available to supplement the clerk's budget, and to report its1 findings to the House of Representatives prior to the convening of the 2015 Regular Session2 of the Legislature of Louisiana.3 DIGEST The digest printed below was prepared by House Legislative Services.
