AN ACT1
To amend and reenact R.S. 27:28(E) and (J) and 431(D), relative to gaming; to prohibit2
application for certain approval, licenses, and permits for a period of five years under3
certain circumstances; to delete provisions regarding a finding of unsuitability based4
upon the failure to make payments to the Internal Revenue Service within a certain5
time period; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1. R.S. 27:28(E) and (J) and 431(D) are hereby amended and reenacted to8
read as follows:9
§28. Suitability standards10

E. Any person whose license or permit has been revoked or who has been12
found unsuitable in this state or any other jurisdiction is not eligible to obtain any13
license or permit pursuant to the provisions of this Title for a period of five years14
from the date the revocation or finding of unsuitability becomes final.  A person15
who has been found unsuitable or whose license, permit, or approval has been16
revoked, in this state or any other jurisdiction, may not apply for a license,17
permit, or approval or a finding of suitability for five years from the date there18
was a finding of unsuitability, or the license, permit, or approval was revoked,19
unless the board allows the application for good cause shown. The board shall20
promulgate rules necessary to carry out the provisions of this Section.21

J. In the awarding of a license, permit, casino operating contract, or other23
approval pursuant to the provisions of this Title, the board and division may consider24
that the person is not current in filing all applicable tax returns and in the payment25
of all taxes, penalties, and interest owed the Internal Revenue Service, excluding26
items under formal appeal.  However, if the board or the division awards a license,27

permit, contract, or other approval to a person who is not current in payments owed1
to the Internal Revenue Service, the person shall subsequently be found unsuitable2
if he is not current in payments owed the Internal Revenue Service within sixty days3
of the issuance of such license, permit, contract, or other approval.4

§431. Powers and duties of the board or division; restrictions; permits6

D. For a period of five years from the date of the revocation of the license,8
no license authorized by this Chapter may be granted to any person whose previous9
license was revoked by the division.  A person who has been found unsuitable or10
whose license, permit, or approval has been revoked, may not apply for a11
license, permit, or approval or a finding of suitability for five years from the12
date there was a finding of unsuitability, or the license, permit, or approval was13
revoked, unless the board allows the application for good cause shown.  The14
board shall promulgate rules necessary to carry out the provisions of this15
Section.16
