AN ACT1
To amend and reenact R.S. 38:2212.2(A) and (B), relative to public contracts; to except2
demolition of certain buildings and structures acquired with the right-of-way for3
construction or improvement of integrated coastal protection projects from certain4
notification and approval prerequisites; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 38:2212.2(A) and (B) are hereby amended and reenacted to read as7
follows:8
ยง2212.2.  Demolition of state buildings9
A. No building or structure owned by the state of Louisiana, except10
highways, bridges, and railroads, and integrated coastal protection projects as11
defined by R.S. 49:214.2(11) and (14), may be razed, demolished, or otherwise12
disposed of unless all members of the legislature representing the district in which13
the state-owned building is located are notified by the division of administration at14
the initiation of the approval process that a request by any agency for such15
demolition has been received by that office or that office has determined that the16
approval process for such demolition shall be initiated, and until authority for such17 SB NO. 104

disposition has been approved in writing by the director of the office of facility1
planning and control, division of administration. Except as provided in Subsection2
C of this Section, in no case shall a request for such authority be approved before3
thirty days after legislative notification.  The request for authority to raze or4
demolish any building or structure as described shall be in compliance with5
procedures adopted and promulgated by the division of administration. Such6
requests shall be accompanied by a resolution or other authorization of the agency,7
board, commission, or other governing authority.8
B. The provisions of this Section shall not apply to buildings acquired with9
the right-of-way for construction or improvement of state highways and integrated10
coastal protection projects as defined by R.S. 49:214.2(11) and (14).11

Section 2. This Act shall become effective upon signature by the governor or, if not13
signed by the governor, upon expiration of the time for bills to become law without signature14
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If15
vetoed by the governor and subsequently approved by the legislature, this Act shall become16
effective on the day following such approval.17

Present law provides that no state-owned building or structure, except highways, bridges,
and railroads, may be razed, demolished, or otherwise disposed of unless (1) the division of
administration notifies all of the legislators representing the district in which the state-owned
building is located that demolition of the building or structure has been requested, and (2)
the office of facility planning and control approves the demolition. Only 30 days after
legislative notification may the director of the office of facility planning and control may
authorize the demolition.
Proposed law retains present law and adds exception for demolition of integrated coastal
protection projects as defined by R.S. 49:214.2(11) and (14).
Effective upon signature of the governor or lapse of time for gubernatorial action.
