Regular Session, 2014 ENROLLED SENATE BILL NO. 104 BY SENATOR ALLAIN AN ACT1 To amend and reenact R.S. 38:2212.2(A), relative to public contracts; to except demolition2 of certain buildings and structures acquired with the right-of-way for construction3 or improvement of integrated coastal protection projects from certain notification4 and approval prerequisites; and to provide for related matters.5 Be it enacted by the Legislature of Louisiana:6 Section 1. R.S. 38:2212.2(A) is hereby amended and reenacted to read as follows:7 ยง2212.2. Demolition of state buildings8 A. No building or structure owned by the state of Louisiana, except9 highways, bridges, and railroads, and integrated coastal protection projects as10 defined by R.S. 49:214.2(11) and (14), may be razed, demolished, or otherwise11 disposed of unless all members of the legislature representing the district in which12 the state-owned building is located are notified by the division of administration at13 the initiation of the approval process that a request by any agency for such14 demolition has been received by that office or that office has determined that the15 approval process for such demolition shall be initiated, and until authority for such16 disposition has been approved in writing by the director of the office of facility17 planning and control, division of administration. Except as provided in Subsection18 C of this Section, in no case shall a request for such authority be approved before19 thirty days after legislative notification. The request for authority to raze or20 demolish any building or structure as described shall be in compliance with21 procedures adopted and promulgated by the division of administration. Such22 requests shall be accompanied by a resolution or other authorization of the agency,23 board, commission, or other governing authority.24 Section 2. This Act shall become effective upon signature by the governor or, if not25 signed by the governor, upon expiration of the time for bills to become law without signature26 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.
