PROCUREMENT CODE. Provides relative to a product preference for certain meat
products in Louisiana. (gov sig)
AN ACT1
To amend and reenact R.S. 38:2251(C)(3) and R.S. 39:1595(C)(3), relative to preferences2
for products produced or manufactured in Louisiana; to provide for a preference for3
certain meat and meat products processed in Louisiana; to provide for an effective4
date; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1. R.S. 38:2251(C)(3) is hereby amended and reenacted to read as follows:7
§2251. Preference for products produced or manufactured in Louisiana; exceptions8

C. In addition to the requirements listed in Subsection B of this Section, the10
following products shall meet the following specific requirements:11

(3) Meat and meat products shall be processed in Louisiana from animals13
which are alive at the time they enter the processing plant that originated in14
Louisiana with traceability documentation supplied by the manufacturer.15

§1595. Preference for all types of products produced, manufactured, assembled,1
grown, or harvested in Louisiana; exceptions2

C. In order to qualify as Louisiana products for the purpose of this Section,4
the following products shall meet the following requirements:5

(3) Meat and meat products shall be processed in Louisiana from animals7
which are alive at the time they enter the processing plant that originated in8
Louisiana with traceability documentation supplied by the manufacturer.9

Section 3. This Act shall become effective upon signature by the governor or, if not11
signed by the governor, upon expiration of the time for bills to become law without signature12
by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If13
vetoed by the governor and subsequently approved by the legislature, this Act shall become14
effective on the day following such approval.15

Present law in the Public Bid Law provides for procurement by state and local public entities
for the purchase of materials and supplies and provisions. The law also provides a
preference for certain products produced or manufactured in Louisiana, including meat and
meat products processed in Louisiana from animals that are alive at the time they enter the
processing plant.
Proposed law provides instead that the meat be processed in Louisiana from animals that
originated in Louisiana with traceability documentation supplied by the manufacturer.
Present law provides a similar preference relative to meat and meat products processed in
Louisiana in the State Procurement Code for supplies purchased by state agencies. Present
law also provides that meat and meat products shall be processed in Louisiana from animals
that are alive at the time they enter the processing plant.
Proposed law to the State Procurement Code proposes a revision that meat be processed in
Louisiana from animals that originated in Louisiana with traceability documentation
supplied by the manufacturer.
Effective upon signature of the governor or lapse of time for gubernatorial action.
