BANKS/BANKING. Prohibits certain banks from charging fees for check cashing. (8/1/14)
AN ACT1
To enact R.S. 10:4-112, relative to state banks; to provide for fees; to provide for terms and2
conditions; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1.  R.S. 10:4-112 is hereby enacted to read as follows:5
ยง4-112.  Payment of check6
A. Notwithstanding any provision of law to the contrary, a payor state7
bank shall pay a check drawn on it against an account with a sufficient balance8
without regard to whether the payee holds an account at the bank.9
B. This Section shall not prohibit a bank from requiring verification of10
the payee's identification by driver's license or similar means before settlement11
of the check.12
C. In addition to any other right or remedy otherwise authorized by law,13
the commissioner of the Office of Financial Institutions, shall ensure that payor14
state banks comply with the requirements of this Section.15
D. For the purposes of this Section, "state bank" shall mean any16
corporation organized under the provisions of Chapter 3 of Title 6 of the17 SB NO. 166

Proposed law provides that notwithstanding any provision of law to the contrary, a payor
state bank shall pay a check drawn on it against an account with a sufficient balance without
regard to whether the payee holds an account at the bank.
Proposed law provides that proposed law shall not prohibit a bank from requiring
verification of the payee's identification by driver's license or similar means before
settlement of the check.
Proposed law provides that in addition to any other right or remedy otherwise authorized by
law, the commissioner of the Office of Financial Institutions, shall ensure that payor state
banks comply with the requirements of proposed law.
Proposed law defines a "state bank" to mean any corporation organized under the provisions
of present law.
Effective August 1, 2014.
