Regular Session, 2014 SENATE BILL NO. 211 BY SENATOR WARD MOTOR VEHICLES. Provides that violation of inspection sticker laws are secondary. (8/1/14) AN ACT1 To amend and reenact R.S. 32:1302(A), relative to motor vehicles; to provide with respect2 to motor vehicle safety inspection requirements; to provide that a safety inspection3 violation constitutes a secondary offense; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 32:1302(A) is hereby amended and reenacted to read as follows: 6 ยง1302. Inspection by officers of the department7 A. DIGEST Ward (SB 211) Present law authorizes the Director of Public Safety, members of the State Police and such other officers and employees of the department as the director may designate, to stop at any time upon reasonable cause to believe that such vehicle is unsafe or not equipped as required by law, or that its equipment is not in proper adjustment or repair, and to require the driver of such vehicle to stop and submit such vehicle to an inspection and such test with reference thereto as may be appropriate. Proposed law updates the Director's title to conform to department name and title changes in present law. Proposed law makes enforcement of safety inspection law a secondary violation and allows a law enforcement officer to stop a vehicle for a safety inspection only as a secondary action when the officer detains a driver for an alleged moving violation of other provisions of Title 32 of the Louisiana Revised Statutes.
