AN ACT1
To amend and reenact R.S. 9:2799.1, relative to civil liability for theft of goods from a2
merchant; to provide relative to liability; to provide for recovery of merchandise; to3
provide for restitution; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 9:2799.1 is hereby amended and reenacted to read as follows: 6
ยง2799.1.  Civil liability for theft of goods from merchant 7
A. Any person who unlawfully takes merchandise from a merchant's8
premises shall be liable to the merchant for the retail value of the merchandise taken,9
if not recovered in merchantable condition, plus damages of not less than fifty nor10
more than five hundred dollars.11
B.  The provisions of this Section shall not be construed to prohibit or limit12
any other cause of action which a merchant may have against a person who13
unlawfully takes merchandise from the merchant's premises.14
C. Any damages under this Section shall be reduced by the amount15
recovered from the offender as restitution to the merchant as a condition of16
sentence.17
