SENATE BILL NO. 390

TRANSPORTATION/DEV DEPT.  Provides relative to the administration of multimodal
transportation by the state. (8/1/14)
AN ACT1
To amend and reenact R.S. 36:508.1(C), (E), and (F), relative to the administration of2
multimodal transportation by the state; and to provide for related matters.3
Be it enacted by the Legislature of Louisiana:4
Section 1. R.S. 36:508.1(C), (E), and (F) are hereby amended and reenacted to read5
as follows:6
ยง508.1. Office of multimodal planning; functions; assistant secretary; powers and7
duties8

C. The assistant secretary shall have authority subject to approval of the10
secretary and in accordance with applicable rules and regulations of the civil service11
commission State Civil Service Commission to employ, appoint, transfer, assign,12
and promote such personnel as is necessary for the efficient administration of the13
office of planning and programming.14

E. The assistant secretary shall administer all department functions and duties16
for which the office of multimodal planning is responsible. He shall also have such17 SB NO. 390

other duties as may be assigned to him by the secretary , by the provisions of this1
Chapter, or by the laws of this state law. He shall report the proceedings of his2
office annually to the secretary of the department and at such other times as the3
secretary may designate, and he shall make any additional reports as are required by4
the secretary.5
F. The secretary is specifically authorized and empowered to may perform6
any of the duties of the assistant secretary when the assistant secretary is absent or7
incapacitated or when in the opinion of the secretary it would be in the best interest8
of the department.  The assistant secretary with approval of the secretary may9
designate a member of the senior staff in the office of multimodal planning to10
perform any duties required of the assistant secretary.11

Present law, relative to the office of multimodal planning within DOTD provides that:
(1)The assistant secretary of the office shall have authority subject to approval of the
secretary and in accordance with applicable rules and regulations of the civil service
commission to employ, appoint, transfer, assign, and promote such personnel as is
necessary for the efficient administration of the office of planning and programming.
(2) The assistant secretary shall administer all DOTD functions and duties for which the
office is responsible.  Further shall also have such other duties as may be assigned
to him by the secretary, pursuant to present law.  Requires that he report the
proceedings of his office annually to the DOTD secretary and at such other times as
the secretary may designate, and make any additional reports as are required by the
secretary.
(3) The secretary is specifically authorized and empowered to perform any of the duties
of the assistant secretary when the assistant secretary is absent or incapacitated or
when in the opinion of the secretary it would be in the best interest of the
department.  Further the assistant secretary with approval of the secretary may
designate a member of the senior staff in the office to perform any duties required
of the assistant secretary.
Proposed law makes technical revisions.  Otherwise retains present law.
Effective August 1, 2014.
