Regular Session, 2014 SENATE BILL NO. 404 BY SENATOR WALSWORTH HEALTH CARE. Provides exemption from licensing for medical personnel traveling with out-of-state sports teams while in Louisiana. (8/1/14) AN ACT1 To enact R.S. 37:24, relative to medical providers; to exempt from licensure certain out-of-2 state licensed medical providers providing services to a sports team while traveling3 with the team in this state for a sporting event; to exempt certain out-of-state licensed4 medical providers providing services at the invitation of a national sport governing5 body at a national sport training center or at an event or competition in this state6 sanctioned by the body; to establish requirements and conditions; and to provide for7 related matters.8 Be it enacted by the Legislature of Louisiana:9 Section 1. R.S. 37:24 is hereby enacted to read as follows: 10 ยง24. Medical providers traveling with sports teams; licensure exemptions11 A.(1) Notwithstanding any other provision of law, a medical provider12 licensed to practice in another state or country shall be exempt from licensure13 requirements of this state while providing medical services for which he is14 licensed, to members of a sports team, coaching staff, or family traveling with15 an out-of-state sports team while in this state if the provider has a written or16 oral agreement with the sports team to provide care to team members, coaching17 SB NO. 404 SLS 14RS-742 ORIGINAL Page 2 of 4 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. staff, and families traveling with the team for a specific sporting event to take1 place in this state.2 (2) The exemption provided in this Section does not authorize the3 provider to provide care or consultation to any person residing in this state,4 other than a person described in Paragraph (1) of this Section, or under the5 Good Samaritan Law or practice at a health care clinic or facility, including an6 acute care facility.7 (3) The exemption shall remain in force only while the provider is8 traveling with the team, but shall be in force no longer than ten days in duration9 per sporting event. The exemption may be extended up to twenty additional10 days per sporting event upon prior request by the provider to the appropriate11 licensing authority but the exemption period may not exceed thirty days total12 per sporting event.13 B.(1) Notwithstanding any other provision of law, a medical provider14 who is licensed to practice in another state or country, shall be exempt from15 licensure requirements in this state while providing medical services for which16 he is licensed if the provider has been invited by a national sport governing17 body to provide medical services at a national sport training center or at an18 event or competition in this state sanctioned by the body and the provider meets19 all the following requirements and conditions:20 (a) The provider has been certified by the national sport governing body21 to the appropriate licensing authority of this state as to state or country of22 origin licensure and the dates within which the provider has been invited to23 provide services.24 (b) The provider's practice is limited to that required by the national25 sport governing body which services shall be within the area of the provider's26 competence and shall only be provided to athletes or team personnel registered27 to train or coach at the center or registered to compete in an event sanctioned28 by the body in this state.29 SB NO. 404 SLS 14RS-742 ORIGINAL Page 3 of 4 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. (2) The exemption shall remain in force while the provider is providing1 services at the invitation of the national sport governing body and only during2 the time certified by the body, but may not exceed thirty days total.3 C. As used in this Section, the following terms and phrases shall have the4 following meanings, except as the context requires otherwise:5 (1) "National sport governing body" includes but is not limited to the6 United States Olympic Committee, the National Football League, the National7 Basketball Association, the National Collegiate Athletic Association, the8 National Association of Intercollegiate Athletics, the National Federation of9 High School Athletic Associations, and the Amateur Athletic Union.10 (2) "Provider" or "medical provider" means an out-of-state licensed11 medical provider who is not licensed in this state, including a physician,12 surgeon, physical therapist, athletic trainer, chiropractor, massage therapist,13 or health care provider as defined in R.S. 40:1299.41.14 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Jerry J. DIGEST Walsworth (SB 404) Proposed law provides that a medical provider who is licensed to practice in another state or country shall be exempt from licensure requirements in this state while providing medical services for which he is licensed, to a member of a sports team, coaching staff, or family accompanying the team while in this state if the provider has a written or oral agreement with the sports team to provide care to team members, coaching staff, and families traveling with the team for a specific sporting event to take place in this state. Provides that the exemption does not authorize the provider to provide care or consultation to any person residing in this state, other than a person described in proposed law or under the Good Samaritan Law or practice at a health care clinic or facility, including an acute care facility. Provides that the exemption shall remain in force only while the provider is traveling with the team, but shall be no longer than 10 days in duration per sporting event. The exemption may be extended up to 20 additional days per sporting event upon prior request by the provider to the appropriate licensing authority but the exemption may not exceed 30 days total per sporting event. (2)The provider's practice is limited to that required by the national sport governing body which services shall be within the area of the provider's competence and shall only be provided to athletes or team personnel registered to train or coach at the center or registered to compete in an event sanctioned by the body in this state. Provides that the exemption shall remain in force while the provider is providing services at the invitation of the national sport governing body and only during the time certified by the body, but may not exceed 30 days total. Defines the following: (1)"National sport governing body" to include but not be limited to the United States Olympic Committee, the National Football League, the National Basketball Association, the National Collegiate Athletic Association, the National Association of Intercollegiate Athletics, the National Federation of High School Athletic Associations, and the Amateur Athletic Union. (2)"Provider" or "medical provider" as an out-of-state licensed medical provider who is not licensed in this state, including a physician, surgeon, physical therapist, athletic trainer, chiropractor, massage therapist, or health care provider as defined in R.S. 40:1299.41.
