ENGINEERS.  Provides relative to the Louisiana Professional Engineering and Land
Surveying Board. (8/1/14)
AN ACT1
To amend and reenact R.S. 37:683(A) and (B)(1) and (2) and (C), relative to the Louisiana2
Engineering and Land Surveying Board; to provide for board appointments; to3
provide for terms; to provide for an effective date; and to provide for related matters.4
Be it enacted by the Legislature of Louisiana:5
Section 1.  R.S. 37:683(A) and (B)(1) and (2) and (C) are hereby amended and6
reenacted to read as follows: 7
ยง683. Board; appointments; terms 8
A.(1) The Louisiana Professional Engineering and Land Surveying Board is9
hereby created, whose duty it shall be to administer the provisions of this Chapter.10
The board shall consist of eleven thirteen members, nine ten of whom shall be11
licensed professional engineers, and two three of whom shall be licensed12
professional land surveyors.13
(2) At least two three members of the board shall be licensed professional14
engineers who are active in the private practice of engineering. For the purposes of15
this Section, an engineer engaged in private practice is a person legally qualified in16
the profession of engineering who practices engineering as a principal business and17 SB NO. 416

who provides analytical, creative design, and design implementation capabilities1
devoid of judgment-biasing commercial or product affiliations to clients on a fee2
basis. At least two of the members of the board shall be licensed professional3
engineers in government employment, at least two of the members of the board shall4
be licensed professional engineers employed in the field of industry, at least two of5
the members shall be licensed professional engineers employed in the field of6
education, and one member shall be a licensed professional engineer employed in the7
field of construction. Two Three members of the board shall be licensed8
professional land surveyors who are actively engaged in the field of surveying. 9
B.(1) The governor shall appoint nine members to the board from among10
licensed professional engineering nominees recommended by the Louisiana11
Engineering Society or its duly recognized successor, one from among licensed12
professional engineering nominees recommended by the American Council of13
Engineering Companies of Louisiana, and three from licensed professional land14
surveyor nominees recommended by the Louisiana Society of Professional15
Surveyors or its duly recognized successor. All such nominees shall have the16
qualifications required by R.S. 37:684.17
(2) At least five three nominations shall be made for each appointment18
required, which appointment shall be made by the governor in the same manner as19
the predecessor appointees were selected.20

C. Each member of the board shall receive a certificate of appointment from22
the governor, and before beginning his term of office, shall file with the secretary of23
state his written oath or affirmation for faithful discharge of his official duty. Each24
member shall serve until his successor has been appointed and qualified. It shall be25
the duty of the president of the Louisiana Engineering Society, in the case of licensed26
professional engineers, or the president of the American Council of Engineering27
Companies of Louisiana, in the case of the licensed professional engineer28
appointed by the governor on their behalf, or the president of the Louisiana29 SB NO. 416

Society of Professional Surveyors, in the case of the licensed professional land1
surveyors, duly authorized and acting on behalf of the respective society to make the2
nominations described above within sixty days after receipt of notice of the death,3
resignation, or removal of a member of the board, and at least thirty days prior to the4
expiration of the term of a member of the board. 5

Present law creates the Louisiana Professional Engineering and Land Surveying Board,
whose duty it shall be to administer the provisions of this Chapter. The board shall consist
of eleven members, nine of whom shall be licensed professional engineers, and two of whom
shall be licensed professional land surveyors.
Proposed law retains present law but increases the number of members from 11 to 13 and
increases the number of licenced professional land surveyors 	from nine to 10. 
Present law provides that the governor shall appoint members to the board from among
licensed professional engineering nominees recommended by the Louisiana Engineering
Society or its duly recognized successor, and from licensed professional land surveyor
nominees recommended by the Louisiana Society of Professional Surveyors or its duly
recognized successor.
Proposed law retains present law but specifies that the governor shall appoint nine members
to the board from among licensed professional engineering nominees recommended by the
Louisiana Engineering Society, one from among licensed professional engineering nominees
recommended by the American Council of Engineering Companies of Louisiana, and three
from licensed professional land surveyor nominees recommended by the Louisiana Society
of Professional Surveyors or its duly recognized successor.
Present law requires that at least five nominations shall be made for each appointment
required.
Proposed law decreases the number of nominations required from five to three. 
Present law provides for nominations following the death, resignation, or removal of a
member of the board.
Proposed law specifies that the American Council of Engineering Companies of Louisiana,
shall make the nominations of its representative members.
Effective August 1, 2014.
