Provides relative to the transfer of interest earned and certain unclaimed fees and costs from the City Court of Lafayette's civil fee account. (8/1/14) AN ACT1 To enact R.S. 13:2078.1, relative to the City Court of Lafayette; to provide relative to the2 City Court of Lafayette civil fee account; to authorize the annual transfer of interest3 earned on the civil fee account to the general operational fund of the court; to4 authorize under certain conditions the transfer of certain unclaimed fees and costs5 in the civil fee account to the general operational fund of the court; to provide certain6 terms, conditions and procedures; and to provide for related matters.7 Be it enacted by the Legislature of Louisiana:8 Section 1. R.S. 13:2078.1 is hereby enacted to read as follows:9 ยง2078.1. City Court of Lafayette; civil fee account10 A. Interest earned on the City Court of Lafayette civil fee account may11 be transferred annually by the judges to the general operational fund of the12 court.13 B. If unclaimed fees and costs in the City Court of Lafayette civil fee14 account have remained unclaimed for a period of three years or more, the15 judges of the court may thereafter transfer the amount of such unclaimed fees16 and costs to the general operational fund of the court. The provisions of this Subsection2 shall not affect any claim or right granted to a claimant by the provisions of the3 Uniform Unclaimed Property Act, R.S. 9:151, et seq.4 The original instrument and the following digest, which constitutes no part of the legislative instrument, were prepared by Julie J. Baxter. DIGEST Proposed law authorizes the annual transfer of interest earned on the City Court of Lafayette civil fee account to the general operational fund of the City Court of Lafayette. Proposed law further provides that unclaimed fees and costs in the City Court of Lafayette civil fee account which have remained unclaimed for a period of three years or more may be transferred to the general operational fund of the City Court of Lafayette. Proposed law further provides that after such transfers, the City Court of Lafayette shall remain liable for the full amount of any viable claim for unclaimed property in accordance with present law. Proposed law further provides that the provisions of proposed law shall not affect any claim or right granted to a claimant by the provisions of the Uniform Unclaimed Property Act, R.S. 9:151 et seq.
