Regular Session, 2014 SENATE BILL NO. 437 BY SENATOR MORRELL SCHOOLS. Requires BESE to create a performance review commission in any public school district in which the Recovery School District has initiated a takeover of schools for more than 5 years. (8/1/14) AN ACT1 To enact R.S. 17:1990.1, relative to the Recovery School District; to require the State Board2 of Elementary and Secondary Education to create Recovery School District3 Performance Review Commissions; to provide for membership; to provide for4 purpose; to provide for reports; to provide for a sunset; and to provide for related5 matters.6 Be it enacted by the Legislature of Louisiana:7 Section 1. R.S. 17:1990.1 is hereby enacted to read as follows: 8 ยง1990.1. Recovery School District Performance Review Commission; creation;9 membership; purpose; reports; sunset10 A. The State Board of Elementary and Secondary Education shall create11 a commission to review the performance of the schools under the jurisdiction12 of the Recovery School District in any city, parish, or other local public school13 district where schools have been transferred to and remained under the14 jurisdiction of the Recovery School District for five or more years.15 B. (1) Two members appointed by the president of the State Board of1 Elementary and Secondary Education.2 (2) One member appointed by the president of the city, parish, or other3 local public school board of the district where the commission is created.4 (3) Two members appointed by the superintendent of the Recovery5 School District.6 (4) One member appointed by the mayor of the city where the7 commission is created.8 (5) Three members who shall be members of an association or other9 collaborative that manages or operates three or more charter schools, appointed10 by the president of the State Board of Elementary and Secondary Education.11 (6) One member appointed by a community-based organization located12 in the district where the commission is created that is actively engaged in efforts13 to improve the quality of public schools.14 C. Each commission created pursuant to this Section shall review the15 performance of the public schools within the local public school district that16 have been transferred to the jurisdiction of the Recovery School District17 through methods including but not limited to the following:18 (1) Comparison of student and school performance data.19 (2) Analysis of the quality of the school environment including student20 body diversity, the enrollment process, opportunities for parental involvement,21 and the physical plant.22 (3) Analysis of the quality of the curriculum, including magnet23 programs, art and music programs, clubs and service organizations, and24 athletics and other extracurricular and intracurricular activities.25 (4) Assessment of student, parent, and community satisfaction with the26 schools and the management of the Recovery School District.27 D. DIGEST Morrell (SB 437) Proposed law requires the State Board of Elementary and Secondary Education (BESE) to create a commission to review the performance of the schools under the jurisdiction of the Recovery School District (RSD) in any city, parish, or other local public school district where schools have been transferred to and remained under the jurisdiction of the RSD for five or more years. Proposed law provides that each such commission created be composed of the following members: (1)Two members appointed by the president of BESE.
