AN ACT1
To enact R.S. 49:125.1, relative to the sale of surplus property; to allow for the transfer of2
surplus electronic devices to certain nonprofit entities; to require the nonprofit3
entities to perform certain services; to provide definitions, terms, conditions, and4
requirements; and to provide for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 49:125.1 is hereby enacted to read as follows:7
ยง125.1.  Electronic device; transfer8
A. Prior to the sale of surplus electronic devices, any political9
subdivision of the state is hereby authorized to transfer surplus electronic10
devices to a nonprofit entity that is certified by R2 Solutions or the e-Stewards11
Initiative. In exchange for the electronic device, the nonprofit entity shall12
perform services that are proportionate to at least the value of the electronic13
device. These services shall, at a minimum, include the pick-up from the14
location specified by the transferring political subdivision and erasure of the15
hard drives or memory of the electronic device to certified standards in order16
to ensure personal privacy protection.  The nonprofit shall also ensure17
environmental protection of the electronic device by a responsible recycling18
process that guarantees the electronic device shall not be disposed of in a19
sanitary landfill or solid waste disposal facility, as defined in R.S. 30:2153.20
B. When used in this Section, "electronic device" shall mean a device or21
a component thereof that contains one or more circuit boards and is used22
primarily for data transfer or storage, communication, or entertainment23
purposes, including but not limited to desktop and laptop computers, computer24
peripherals, monitors, copying machines, scanners, printers, radios, televisions,25

camcorders, video cassette recorders, compact disc players, digital video disc1
players, MP3 players, telephones, including cellular and portable telephones,2
and stereos.3
