AN ACT1
To enact R.S. 40:4.13(D)(10), relative to water systems; to provide with respect to the2
Louisiana Standards for Water Works Construction, Operation, and Maintenance3
Committee; to provide for application of certain rules and regulations; and to provide4
for related matters.5
Be it enacted by the Legislature of Louisiana:6
Section 1.  R.S. 40:4.13(D)(10) is hereby enacted to read as follows:7
ยง4.13. Water systems; National Primary Drinking Water Regulations; sanitary8
survey; use of Ten State Standards9

(10) The rules and regulations promulgated pursuant to12
Paragraph(D)(2) of this Section shall not apply to a water system whose license13
is in good standing with the office of public health of the Department of Health14
and Hospitals on the date such rules and regulations become effective.15

Present law provides the Louisiana Standards for Water Works Construction, Operation, and
Maintenance Committee (the committee) shall be created within the Department of Health
and Hospitals (DHH) to develop standards to be placed in the state Sanitary Code for water
works construction, operation, and maintenance.
Present law provides no later than August 1, 2014, the office of public health of DHH shall
promulgate rules and regulations pursuant to the Administrative Procedure Act
implementing the standards developed by the committee.
Proposed law amends present law to provide the promulgated rules and regulations pursuant
to present law shall not apply to a water system whose license is in good standing with the
office of public health of DHH on the date such rules and regulations become effective.
Effective August 1, 2014.
