Regular Session, 2014 SENATE BILL NO. 646 BY SENATOR PETERSON EMPLOYMENT. Requires public contractors to pay certain minimum wages to employees. (8/1/14) AN ACT1 To enact R.S. 38:2301 and R.S. 39:1555, relative to wages; to require public contractors to2 pay certain prevailing minimum wages; to provide for the inclusion of certain3 language in public contacts; and to provide for related matters.4 Be it enacted by the Legislature of Louisiana:5 Section 1. R.S. 38:2301 is hereby enacted to read as follows: 6 PART VI. PAYMENT OF PREVAILING WAGES7 §2301. Prevailing wage; requirement of contractors8 A. No person awarded a public contract pursuant to the provisions of9 this Title shall pay any employee wages in an amount less than the prevailing10 minimum wage set forth as follows:11 (1) Beginning January 1, 2015, the amount of the minimum wage shall12 be eight dollars and twenty-five cents per hour.13 (2) Beginning January 1, 2016, the amount of the minimum wage shall14 be nine dollars and twenty-five cents per hour.15 (3) Beginning January 1, 2017, the amount of the minimum wage shall16 be ten dollars and twenty-five cents per hour.17 SB NO. 646 SLS 14RS-1556 ORIGINAL Page 2 of 3 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. B. Every public contract and bidding document executed pursuant to1 the provisions of this Title shall include a statement advising that by signing the2 contract, the contractor agrees to pay the prevailing wage as provided for in this3 Section.4 C. The provisions of this Section shall not apply to any political5 subdivision as provided for in Article VI of the Constitution of Louisiana and6 as defined in Article VI, Section 44 of the Constitution of Louisiana.7 Section 2. R.S. 39:1555 is hereby enacted to read as follows:8 §1555. Prevailing wage; requirement of procurement contracts9 A. No person awarded a procurement contract pursuant to the10 provisions of this Title shall pay any employee wages in an amount less than the11 prevailing minimum wage set forth as follows:12 (1) Beginning January 1, 2015, the amount of the minimum wage shall13 be eight dollars and twenty-five cents per hour.14 (2) Beginning January 1, 2016, the amount of the minimum wage shall15 be nine dollars and twenty-five cents per hour.16 (3) Beginning January 1, 2017, the amount of the minimum wage shall17 be ten dollars and twenty-five cents per hour.18 B. Every public contract, invitation to bid, or request for proposal19 pursuant to the provisions of this Title shall include a statement advising an20 applicant that by signing the contract, bid document, or proposal, the applicant21 agrees that the applicant will pay the prevailing wage as provided for in this22 Section.23 C. DIGEST Peterson (SB 646) Proposed law provides that no person awarded a public contract shall pay any employee a minimum wage which is less than the following: (1)Beginning January 1, 2015, the amount of the minimum wage shall be $8.25 per hour. (2)Beginning January 1, 2016, the amount of the minimum wage shall be $9.25. (3)Beginning January 1, 2017, the amount of the minimum wage shall be $10.25. Proposed law provides that every contract, invitation to bid, or request for proposal shall include a statement advising that by signing the contract, the contractor agrees to pay the prevailing minimum wage. Proposed law provides that the proposed law shall not apply to a parish, municipality, and any other unit of local government, including a school board and a special district, authorized by law to perform local governmental functions.
