AN ACT1
To enact Chapter 21 of Title 24 of the Louisiana Revised Statutes of 1950, to be comprised2
of R.S. 24:1001 through 1005, relative to the Louisiana State Health Care Profession3
Institute; to provide for its creation and membership; to provide for its duties,4
functions, and responsibilities; to provide for compensation; to provide relative to5
reporting; and to provide for related matters.6
Be it enacted by the Legislature of Louisiana:7
Section 1.  Chapter 21 of Title 24 of the Louisiana Revised Statutes of 1950,8
comprised of R.S. 24:1001 through 1005, is hereby enacted to read as follows:9
CHAPTER 21. LOUISIANA STATE HEALTH CARE PROFESSION INSTITUTE10
§1001. Creation11
The Louisiana State Health Care Profession Institute is created and12
organized as an official research agency of the Legislature of Louisiana.13
§1002. Council; membership14
The governing body of the Louisiana State Health Care Profession15
Institute shall be a council composed of the following members:16

(2) The president of the Louisiana Senate or his designee.2
(3) The speaker of the Louisiana House of Representatives or his3
designee.4
(4) The chairman of the Senate Committee on Health and Welfare or his5
designee.6
(5) The chairman of the House Committee on Health and Welfare or his7
designee.8
(6) The executive director of the Louisiana State Board of Medical9
Examiners or his designee.10
(7) The executive director of the Louisiana State Board of Dentistry or11
his designee.12
(8) The executive director of the Louisiana State Board of Nursing or his13
designee.14
(9) The executive director of the Louisiana State Board of Practical15
Nurse Examiners or his designee.16

(25) The executive director from the Louisiana Licensed Professional18
Vocational Rehabilitation Counselors Board of Examiners or his designee.19

(27) The chairman of the Louisiana Behavior Analyst Board or his22

(28) The chairman of the Louisiana State Board of Medical Examiners24
Occupational Therapy Advisory Committee or his designee.25

(32) A clinical social worker licensed and selected by the Louisiana State2
Board of Social Work Examiners.3
§1003.  Plans of membership; compensation of members of council4
The council of the Louisiana State Health Care Profession Institute is5
empowered to adopt a plan or plans of membership so designed as to encourage6
and invite the cooperation of all members of the health care profession in the7
work of the institute. The members of the council shall serve without any8
compensation for services as such.  However, the council may fix and pay9
reasonable compensation to the director of the institute, and honoraria to10
members of the council who perform professional service for the institute,11
authorized by the council or the institute.  Such employment or payment shall12
not be deemed a violation of any criminal law punishing the holding of more13
than one public office or employment in Louisiana.14
§1004. General purpose; duties15
A. The general purpose for which the Louisiana State Health Care16
Profession Institute is formed is to carry on research regarding health care17
professions. To that end it shall be the duty of the Louisiana State Health Care18
Profession Institute:19
(1) To consider needed improvements with the professions providing20
health care services and to make recommendations concerning the same to the21
legislature.22
(2) To examine and study the scope of practices of health care23
professionals and recommend needed reforms.24
(3) To receive and consider suggestions from the legislature and the25
public generally as to issues regarding health care professions and the services26
such professions provide.27
(4) To recommend from time to time such changes in the law as it deems28
necessary to modify or eliminate antiquated and inequitable scope of health29 SB NO. 649

care profession issues, and provide assistance to the legislature to bring the laws1
and regulations of the state into harmony with modern health care conditions.2
(5) To render annual reports to the legislature, and if it deems advisable,3
to accompany its reports with proposed bills to carry out any of its4
recommendations.5
(6) To organize and conduct an annual meeting in the state for6
discussions of current problems with the professions of health care, bringing7
together representatives of the legislature, practicing health care professionals,8
and representatives of the health care teaching profession.9
(7) To select a director.10
B. Legislation submitted on recommendation of the Louisiana State11
Health Care Profession Institute shall have affixed to it a digest of the12
legislation. The digest shall be prepared by the Louisiana State Health Care13
Profession Institute. The form and contents of the digest shall be as prescribed14
by the rules or practice of the legislature for digests of legislative instruments,15
but shall include a summary of each minority report authored by a member of16
the law institute. The digest shall not constitute a part of the legislation.17
C. Any member of the Louisiana State Health Care Profession Institute18
may author a minority report regarding any legislation submitted on19
recommendation of the Louisiana State Health Care Profession Institute. The20
minority report shall include comments which accurately reflect a dissenting21
position or adverse position expressed by such member. Any other member may22
join and sign such minority report; however, no member may sign more than23
one minority report. The author of the minority report shall submit a copy of24
such report to each member of each standing committee of each house of the25
legislature to which such recommended legislation has been or is expected to be26
referred. All costs associated with furnishing such copies shall be paid by the27
Louisiana State Health Care Profession Institute. Additionally, any member28
signing a minority report may present such report at any legislative hearing29 SB NO. 649

held on such recommended legislation.1
D. The legislature shall provide administrative resources to the2
Louisiana State Health Care Profession Institute.3
§1005.  Reports; advisory capacity; printing and distribution of reports4
The Louisiana State Health Care Profession Institute, in submitting5
reports to the legislature shall act solely in an advisory capacity.  Its reports,6
studies, and recommended publications shall be printed and shall be distributed7
by the legislature.8

(7)To select a director.
