HOUSE BILL NO. 228
BY REPRESENTATIVES REYNOLDS AND HENRY BURNS
MINERALS/RIGHTS-ROYALTY:  Dedicates a certain amount of mineral revenues from
oil and gas production in and around Lake Bistineau to weevil production for control
of giant salvinia in the lake
1	AN ACT
2To enact R.S. 56:10.2, relative to state mineral income from activity in and adjacent to Lake
3 Bistineau; to dedicate a portion of such revenue to weevil production for control of
4 giant salvinia in the lake; to create the Lake Bistineau Management Account in the
5 Conservation Fund; to provide for the use of monies in the account; to provide
6 legislative oversight; to provide for termination; to provide for an effective date; and
7 to provide for related matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 56:10.2 is hereby enacted to read as follows:
10 ยง10.2.  Lake Bistineau Management Account; dedication of mineral activity
11	revenues
12	A.  Notwithstanding any other provision of law to the contrary, after
13 allocation of monies to the Bond Security and Redemption Fund as provided in
14 Article VII, Section 9(B) of the Constitution of Louisiana, and after satisfying the
15 required allocations in Article VII, Sections 4, 10-A, and 10.2 of the Constitution of
16 Louisiana, in the event a research facility is constructed at Lake Bistineau for weevil
17 production and research into the utility of using surface mowing boats for control of
18 giant salvinia, an amount not to exceed ninety-five thousand dollars annually shall
19 be deposited by the state treasurer from the Conservation Fund into the Lake

1 Bistineau Management Account in the Conservation Fund, hereinafter referred to as
2 the "account", which is hereby created as a special account in the Conservation Fund,
3 until a total of three hundred thousand dollars has been deposited into the account. 
4 The monies in the account shall be invested by the treasurer in the manner provided
5 by law, and interest earned on the investment of those monies shall be deposited in
6 and credited to the Conservation Fund.  All unexpended or unencumbered monies
7 remaining in the account at the end of the fiscal year shall remain in the account.
8	B.  Upon construction  of a research facility at Lake Bistineau for production
9 of weevil for control of giant salvinia, the monies in the account shall be
10 appropriated each year by the legislature for use exclusively by the Department of
11 Wildlife and Fisheries for weevil production and research into the utility of using
12 surface mowing boats for control of giant salvinia in Lake Bistineau.  Each year's
13 plan for the expenditure of monies appropriated from the account shall be subject to
14 the approval of the House Committee on Natural Resources and Environment and
15 the Senate Committee on Natural Resources.
16	C.  The provisions of this Section shall terminate and become null and void
17 upon the expenditure of a total of three hundred thousand dollars by the Department
18 of Wildlife and Fisheries for weevil production and research into the utility of using
19 surface mowing boats for control of giant salvinia in Lake Bistineau from monies
20 deposited into the account.
21 Section 2.  This Act shall become effective on July 1, 2015; if vetoed by the governor
22and subsequently approved by the legislature, this Act shall become effective on July 1,
232015, or on the day following such approval by the legislature, whichever is later.

Proposed law dedicates an amount not to exceed $95,000 annually from the Conservation
Fund for control of giant salvinia in Lake Bistineau until a total of $300,000 has been
dedicated.  Creates the Lake Bistineau Management Account in the Conservation Fund and
deposits the dedication into the account. 
 
Proposed law further requires appropriation of the monies in the account to the Dept. of
Wildlife and Fisheries for weevil production and research into the utility of using surface
mowing boats for control of giant salvinia in Lake Bistineau.
Proposed law requires the construction of a research facility on Lake Bistineau before
monies will be dedicated or appropriated for control of giant salvinia in Lake Bistineau.   
Proposed law requires approval by the House Committee on Natural Resources and
Environment and the Senate Committee on Natural Resources each year of the plan for
expenditure of monies appropriated from the account.
Proposed law terminates and becomes null and void when $300,000 has been expended by
the Dept. of Wildlife and Fisheries from the account for control of giant salvinia in Lake
Bistineau. 
Effective July 1, 2015.

Summary of Amendments Adopted by House
The Committee Amendments Proposed by House Committee on Appropriations to the
original bill:
1. Require the construction of a research facility on Lake Bistineau before monies
are dedicated or appropriated for the production of weevil for control of giant
salvinia in Lake Bistineau.
2. Change the dedication from $300,000 annually to an amount not to exceed
$95,000 annually until a total of $300,000 has been deposited into the Lake
Bistineau Management Account in the Conservation Fund.
3. Change the source of the dedication from the state's mineral income from activity
on certain  water bottoms of Lake Bistineau to the Conservation Fund.
4. Change the deposit of interest earned on the Lake Bistineau Management
Account from the Lake Bistineau Management Account to the Conservation
Fund. 
5. Change the termination of proposed law from July 1, 2017, to the expenditure of
$300,000 by the Dept. of Wildlife and Fisheries for control of giant salvinia in
Lake Bistineau from monies deposited into the Lake Bistineau Management
Account in the Conservation Fund.
The House Floor Amendments to the engrossed bill:
