HOUSE BILL NO. 37
BY REPRESENTATIVE BROWN
1	AN ACT
2 To amend and reenact R.S. 32:402.1(D) and to enact R.S. 32:410(D), 412(D)(3)(f) and
3 (4)(d), and R.S. 40:1321(N), relative to driver's licenses and special identification
4 cards; to provide for participation in driver training programs; to provide the option
5 for a driver to place their blood type on the front of their license; to provide for
6 driver's license renewal for individuals with a disability; and to provide for related
7 matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 32:402.1(D) is hereby amended and reenacted and R.S. 32:410(D)
10 and 412(D)(3)(f) and (4)(d) are hereby enacted to read as follows:
11 §402.1. Driver education; required

13	D.  No person under the age of fifteen shall be allowed to enroll or participate
14 in the driving experience portion of any driver education course or driver training
15 program.  A person, no sooner than ninety days prior to his fifteenth birthday and
16 who is in, at a minimum, grade nine eight, shall be permitted to participate in the
17 classroom instruction component of a driver education course or driving program.

19 §410.  Form of license; photograph, signature of licensee, anatomical gift statement,
20	declaration of life-sustaining procedures, and additional information on

23	D.(1)  Upon request, the license holder's blood type shall be exhibited on the
24 back of the driver's license regardless of its class.  No additional fee shall be charged

1 to include such designation.  The deputy secretary of the Department of Public
2 Safety and Corrections, public safety services, shall promulgate, in accordance with
3 the Administrative Procedure Act, rules and regulations necessary to implement the
4 provisions of this Subsection.
5	(2)  No action taken by any person, whether private citizen or public officer
6 or employee, with regard to any driver's license displaying a blood type, shall create
7 a warranty of the reliability or accuracy of the document or electronic image, or
8 create any liability on the part of the state, or on the part of any department, office,
9 or agency of the state, or on the part of any officer, employee, or agent of the state.

12	university logo; "I'm a Cajun" designation; disbursement of funds; renewal
13	by mail or electronic commerce of Class "D" or "E" drivers' licenses;

18	(3)  A Class "D" or "E"  operator's license may be renewed by mail or
19 electronic commerce, except as follows:

21	(f)  Notwithstanding Subparagraphs (a) and (b) of this Paragraph, a renewal
22 by mail may be granted to a person seventy years of age or older who is medically
23 diagnosed with a disability that precludes that person from renewing their license in
24 person.
25	(4)  The renewal by mail or electronic commerce shall include the following:

27	(d)  If the person seeking the renewal is seventy years of age or older, a
28 sworn affidavit by a physician certifying that the person possesses all cognitive
29 functions reasonably necessary to be a prudent driver.

1 Section 2.  R.S. 40:1321(N) is hereby enacted to read as follows:
2 §1321.  Special identification cards; issuance; veteran designation; university logo;
3	"I'm a Cajun" designation; fees; expiration and renewal; exceptions;
4	promulgation of rules; promotion of use; persons less than twenty-one years
5	of age; the Protect and Save our Children Program; Selective Service
6	Registration

8	N.(1)  Upon request, the special identification card holder's blood type shall
9 be exhibited on the back of the special identification card.  No additional fee shall
10 be charged to include such designation. The deputy secretary of the Department of
11 Public Safety and Corrections, public safety services, shall promulgate, in
12 accordance with the Administrative Procedure Act, rules and regulations necessary
13 to implement the provisions of this Subsection.
14	(2)  No action taken by any person, whether private citizen or public officer
15 or employee, with regard to any identification card displaying a blood type, shall
16 create a warranty of the reliability or accuracy of the document or electronic image,
17 or create any liability on the part of the state, or on the part of any department, office,
18 or agency of the state, or on the part of any officer, employee, or agent of the state.
