CORRECTIONS:  Reduces the amount of the per diem DPS&C pays to sheriffs for housing
state inmates
1	AN ACT
2To amend and reenact R.S. 15:824(B)(1)(a), relative to the housing of inmates; to provide
3 relative to persons committed to the custody of the Department of Public Safety and
4 Corrections who are housed in a parish jail; to reduce the amount of the
5 reimbursement paid to the sheriffs for the housing of these inmates in parish jails;
6 and to provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 15:824(B)(1)(a) is hereby amended and reenacted to read as follows: 
9 ยง824.  Commitment of persons to the Department of Public Safety and Corrections

11	B.(1)(a)  In the event any individual has been committed to the department
12 for confinement which is or has been delayed or prevented after final sentence by
13 court order restricting the department from institutionalizing the individual, or when
14 the individual is not institutionalized in a state penal or corrections institution
15 because of lack of facilities under the control of the department, or the department
16 otherwise refused to accept the individual for confinement, which resulted or has
17 resulted in the individual being confined in a parish jail or institution after final
18 sentence, or when he is being held in the parish jail without bail, pending an appeal,
19 or when he is a participant in a Blue Walters Substance Abuse Program by order of

1 a court in lieu of revocation of probation or by the board or committee on parole in
2 lieu of revocation of parole, the department shall pay to each parish sheriff, or to the
3 governing authority of those parishes in which the governing authority operates the
4 parish jail, for keeping and feeding the individual in the parish jail the sum of
5 twenty-four twenty-three dollars and thirty-nine cents per day.  Such daily sum shall
6 be paid from date of sentencing until the individual is confined in a penal or
7 correctional institution under the supervision of the department.

Abstract:  Reduces the amount of per diem the Dept.  of Public Safety and Corrections pays
sheriffs for housing state inmates from $24.39 per day to $23.39 per day.
Present law provides that for any individual committed to the custody of DPS&C who is
housed in a parish jail, the department shall pay to each parish sheriff, or to the governing
authority of those parishes in which the governing authority operates the parish jail, for
keeping and feeding the individual in the parish jail the sum of $24.39 per day.  This daily
sum shall be paid from date of sentencing until the individual is confined in a penal or
correctional institution under the supervision of the department.
Proposed law reduces the reimbursement amount from $24.39 per day to $23.39 per day.
