ENROLLED ACT No. 331 2015 Regular Session HOUSE BILL NO. 392 BY REPRESENTATIVE LOPINTO 1 AN ACT 2 To enact R.S. 15:1212 and 1212.1, relative to the Louisiana Commission on Law 3 Enforcement and the Administration of Criminal Justice; to require the commission 4 to create and maintain a database for deposit of information relative to law 5 enforcement officers; to provide for the functions, powers, and duties of the 6 commission relative to the database; to provide for reporting requirements relative 7 to all law enforcement agencies throughout the state; to authorize the promulgation 8 of rules and regulations; and to provide for related matters. 9 Be it enacted by the Legislature of Louisiana: 10 Section 1. R.S. 15:1212 and 1212.1 are hereby enacted to read as follows: 11 §1212. Creation of database; functions 12 A. There is hereby created within the Louisiana Commission on Law 13 Enforcement and the Administration of Criminal Justice, hereinafter referred to as 14 the "commission", a Louisiana Uniform Law Enforcement Statewide Reporting 15 Database, hereinafter referred to as the "database". The commission may appoint 16 such employees, agents, consultants, and special committees as it may deem 17 necessary to properly manage the database. 18 B. The commission shall be the central depository for all information 19 submitted for entry into the database and shall have the following functions, powers, 20 and duties: Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HB NO. 392 ENROLLED 1 (1) To establish, through electronic data processing and related procedures, 2 a database by which relevant information can be collected, coordinated, analyzed, 3 and made readily available to serve qualified law enforcement agencies concerned 4 with the hiring practices and training of law enforcement officers located anywhere 5 in the state. The commission shall prescribe the terms and conditions under which 6 such agencies shall contribute or gain access to information contained in the database 7 files. 8 (2) To adopt such measures to assure the security of the database as may be 9 specified in state and federal regulations. 10 (3) To adopt and publish for distribution to the database users, the operating 11 policies, practices and procedures, and conditions of qualification for data access. 12 (4) To prepare and distribute, to all such persons and agencies, forms to be 13 used in reporting data to the database. The forms shall provide for information 14 regarding the name of the law enforcement officer, the designated position, all 15 certifications related to training and qualifications, the hire date, and the date of 16 separation from service. 17 (5) To instruct such persons and agencies in the installation, maintenance, 18 and use of employment-based records and in the manner of reporting to the database. 19 (6) To tabulate, analyze, and interpret the data collected. 20 (7) To make, solicit, and request proposals and offers, and to execute and 21 effectuate agreements or contracts for the operation of any part of the database. 22 (8) To promulgate rules and regulations to carry out the functions, powers, 23 and duties set forth in this Section. 24 §1212.1. Report to the system; duties of persons and agencies 25 A. All law enforcement agencies, correctional agencies, and institutions shall 26 provide the required data as provided for in R.S. 15:1212(B)(4) in accordance with 27 the rules adopted by the Louisiana Commission on Law Enforcement and the 28 Administration of Criminal Justice. Upon the request of the commission, all law enforcement agencies shall 2 provide any other such assistance, information, and data which are reasonable and 3 available to enable the commission to properly carry out its powers and duties.
