HOUSE BILL NO. 448
BY REPRESENTATIVE PUGH
1	AN ACT
2 To amend and reenact R.S. 32:663(B) and 853(B), relative to motor vehicles; to provide
3 relative to the qualifications and competence of those issued permits for the purpose
4 of chemical testing for drivers suspected of operating a vehicle while impaired; to
5 increase fees for copies of certain financial responsibility documents; and to provide
6 for related matters.
7 Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 32:663(B) and 853(B) are hereby amended and reenacted to read as
9 follows:
10 §663.  Approval of testing methods by Department of Public Safety and Corrections

12	B.  The Department of Public Safety and Corrections may use an individual's
13 or a laboratory's certification by one or more of the following professional
14 organizations in its determination of the qualifications and competence of individuals
15 as required by Subsection A of this Section prior to the issuance of a permit.  The
16 certification by the following professional organizations may be considered in
17 issuing such permits:
18	(1)  College of American Pathologists (CAP).
19	(2)  American Board of Forensic Toxicology (ABFT).
20	(3)  Forensic Quality Services (FQS).
21	(4)  American Society of Crime Lab Laboratory Directors/Laboratory
22 Accreditation Board (ASCLD/LAB).
23	(5)  American Association for Laboratory Accreditation (A2LA).

1 §853. Commissioner to furnish operating records; other information; fees;
2	withdrawal of forms or information

4	B.(1)  The commissioner shall be entitled to charge and collect a fee of six
5 sixteen dollars for each copy of a certified abstract and for each copy of any
6 information furnished upon request of any person from the files of the financial
7 responsibility division of the Department of Public Safety and Corrections.
8 Notwithstanding any other fees as stipulated herein, the fee for furnishing motor
9 vehicle reports that are derived from computer generated requests shall not exceed
10 six sixteen dollars for records from all sources.
11	(2)(a)  Subject to the exceptions contained in Article VII, Section 9(B) of the
12 Constitution of Louisiana, all fees, fines, or other monies collected under the
13 provisions of this Chapter or dedicated to the enforcement of the provisions of this
14 Chapter shall be paid to the state treasury and shall be credited to the Bond Security
15 and Redemption Fund.

17 Section 2.  This Act shall become effective on July 1, 2015.
