HLS 15RS-581 ORIGINAL 2015 Regular Session HOUSE BILL NO. 459 BY REPRESENTATIVE MORENO LOTTERY: Dedicates unclaimed lottery prize money to the New Orleans Public Safety Fund 1 AN ACT 2To amend and reenact R.S. 47:9025(D) and to enact R.S. 40:1402, relative to lottery 3 revenues; to create the New Orleans Public Safety Fund in the state treasury; to 4 provide for deposit, use, and investment of the money in the fund; to provide for the 5 use of certain unclaimed lottery prize money; and to provide for related matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 40:1402 is hereby enacted to read as follows: 8 §1402. New Orleans Public Safety Fund 9 A. There is hereby created in the state treasury the New Orleans Public 10 Safety Fund, hereinafter referred to as the "fund". After satisfying the requirements 11 of the Bond Security and Redemption Fund as provided in Article VII, Section 9(B) 12 of the Constitution of Louisiana, the treasurer shall deposit into the fund the 13 unclaimed lottery prize money transferred by the Louisiana Lottery Corporation, 14 pursuant to R.S. 47:9025(D). All unexpended and unencumbered monies in the fund 15 at the end of the year shall remain in the fund. Monies in the fund shall be invested 16 by the treasurer in the same manner as monies in the state general fund, and any 17 interest earned on such investment shall be deposited in and credited to the fund. 18 B. Monies in the fund shall be appropriated by the legislature to the office 19 of state police for public safety services, including patrol and law enforcement, in the 20 area of the city of New Orleans within the following boundaries: the Mississippi 21 River, the center line of Canal Street, the rear property line of the properties fronting Page 1 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. R.S. 47:9025(D) is hereby amended and reenacted to read as follows: 4 §9025. Prizes taxable; withholdings from prize; verification and payment; 5 exceptions; unclaimed prize money; corporation liability; eligibility to 6 purchase ticket and receive prize 7 * * * 8 D.(1) Any Except as provided in Paragraph (2) of this Subsection, unclaimed 9 prize money shall be added to the pool from which future prizes are to be awarded 10 or used for special prize promotions. 11 (2) Out of any balance of unclaimed prize money held by the Louisiana 12 Lottery Corporation at the end of each fiscal year, two million five hundred thousand 13 dollars shall be transferred by the Louisiana Lottery Corporation to the state treasury 14 for deposit into the New Orleans Public Safety Fund, as provided in R.S. 40:1402. 15 * * * DIGEST The digest printed below was prepared by House Legislative Services. Money in the fund shall be used by the office of state police for patrol in and law enforcement of the French Quarter area in New Orleans. Present law provides for certain time periods for winning lottery prizes to be claimed. Lottery prizes not claimed within these time periods are added to a pool from which future prizes are to be awarded or used for special prize promotions. Proposed law retains present law but dedicates $2.5 million of the remaining balance of unclaimed lottery prize money at the end of each fiscal year into the New Orleans Public Safety Fund created in proposed law. Proposed law provides that monies in the New Orleans Public Safety Fund shall be used by the office of state police for public safety services, including patrol and law enforcement, in the French Quarter area of the city of New Orleans.
