HEALTH SERVICES:  Provides relative to the regulation of telemedicine and telehealth
services
1	AN ACT
2To amend and reenact R.S. 37:1276.1(A) and (B)(introductory paragraph), relative to
3 telemedicine; to provide for a telemedicine license; to provide for the regulation of
4 telemedicine; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 37:1276.1(A) and (B)(introductory paragraph) are hereby amended
7and reenacted to read as follows:
8 ยง1276.1.  Telemedicine license
9	A.  The board shall issue a telemedicine license as provided for in R.S.
10 37:1271 to allow the practice of medicine across state lines to an applicant who holds
11 a full and unrestricted license to practice medicine in another state or territory of the
12 United States.
13	B.  The board shall establish by rule in accordance with the Administrative
14 Procedure Act the requirements for licensure under this Section. provided the The
15 rules, at a minimum, shall include the following:

Abstract:  Provides for the regulation of telemedicine by the La. State Board of Medical
Examiners.
Present law requires the La. State Board of Medical Examiners (LSBME) to issue a
telemedicine license to allow the practice of medicine across state lines to an applicant who
holds a full and unrestricted license to practice medicine in another state or territory of the
United States.
Proposed law retains present law but adds a reference to the provision of present law
requiring physicians to hold an unrestricted license to practice medicine in La. or a
telemedicine license issued by the LSBME.
Present law requires the LSBME to promulgate administrative rules for the requirements for
licensure.  Further requires the rules to provide for certain content.
Proposed law retains present law but clarifies there are minimum requirements for the
administrative rules.
