FUNDS/FUNDING: (Constitutional Amendment) Prohibits the transfer or appropriation
of money out of a fund except as authorized by the constitutional or statutory
provisions for the fund
1 A JOINT RESOLUTION
2Proposing to add Article VII, Section 10(K) of the Constitution of Louisiana, relative to state
3 funds; to limit the transfer and appropriation of monies out of dedicated funds; to
4 provide for submission of the proposed amendment to the electors; and to provide
5 for related matters.
6 Section 1. Be it resolved by the Legislature of Louisiana, two-thirds of the members
7elected to each house concurring, that there shall be submitted to the electors of the state of
8Louisiana, for their approval or rejection in the manner provided by law, a proposal to add
9Article VII, Section 10(K) of the Constitution of Louisiana, to read as follows:
10 §10. Expenditure of State Funds

13 (K) Dedicated funds. Except as provided by Paragraph (F) of this Section,
14 monies deposited into a dedicated fund shall not be appropriated out of the fund or
15 transferred out of the fund for any purpose not authorized by the constitutional or
16 statutory provision setting forth the purpose and use of the dedicated fund.

1 Section 2. Be it further resolved that this proposed amendment shall be submitted
2to the electors of the state of Louisiana at the statewide election to be held on October 24,
32015.
4 Section 3. Be it further resolved that on the official ballot to be used at the election,
5there shall be printed a proposition, upon which the electors of the state shall be permitted
6to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as
7follows:
8 Do you support an amendment that prohibits the appropriation or transfer of
9 money out of a dedicated fund for a purpose inconsistent with the
10 constitutional or statutory provision establishing the purpose and use of the
11 dedicated fund? (Adds Article VII, Section 10(K))

Abstract: Prohibits appropriating or transferring money out of a dedicated fund for a
purpose inconsistent with the constitutional or statutory provision establishing the
purpose and use of the dedicated fund.
Proposed constititional amendment prohibits appropriating or transferring money out of a
dedicated fund for a purpose inconsistent with the constitutional or statutory provision
establishing the purpose and use of the dedicated fund. The prohibition does not apply to
transfers authorized in present constitution to cure a projected deficit in the current year or
next fiscal year.
Provides for submission of the proposed amendment to the voters at the statewide election
to be held Oct. 24, 2015.
