HLS 15RS-1201 ORIGINAL 2015 Regular Session HOUSE BILL NO. 622 BY REPRESENTATIVE PIERRE PUBLIC CONTRACT/BIDS: Provides relative to the public bid process undertaken by the city of Lafayette, parish of Lafayette, and the Lafayette City-Parish Consolidated Government 1 AN ACT 2To enact R.S. 38:2212(AA), relative to public bidding; to allow the city of Lafayette, the 3 parish of Lafayette, and Lafayette City-Parish Consolidated Government to utilize 4 construction time and life cycle costs as factors in determining the lowest responsive 5 bidder, in addition to bid cost; and to provide for related matters. 6 Notice of intention to introduce this Act has been published 7 as provided by Article III, Section 13 of the Constitution of 8 Louisiana. 9Be it enacted by the Legislature of Louisiana: 10 Section 1. R.S. 38:2212(AA) is hereby enacted to read as follows: 11 ยง2212. Advertisement and letting to lowest responsible and responsive bidder; 12 public work; electronic bidding; participation in mentor 13 * * * 14 AA. Notwithstanding the provisions of this Chapter or any other law to the 15 contrary, the city of Lafayette, the parish of Lafayette, and the Lafayette City-Parish 16 Consolidated Government may utilize construction time and life cycle cost to 17 determine the lowest responsive bidder, in addition to bid cost. Bidding documents 18 may contain alternates which allow for different materials or methods of 19 construction. HLS 15RS-1201 ORIGINAL HB NO. 622 1 determined based on the lowest bid cost, the lowest combination of bid cost plus 2 construction time, or the lowest combination of bid cost plus construction time plus 3 estimated life cycle cost. If construction time is utilized as a factor to determine the 4 lowest responsive bidder, then its value and use in the determination of the lowest 5 responsive bidder shall be specified in the bidding documents. 6 Section 2. This Act shall become effective upon signature by the governor, 7 if not signed by the governor, upon expiration of the time for bills to become law 8 without signature by the governor, as provided in Article III, Section 18 of the 9 Constitution of Louisiana. If vetoed by the governor and subsequently approved by 10 the legislature, this Act shall become effective on the day following such approval. Present law allows the Dept. of Transportation and Development to award public works contracts on the basis of construction time and life cycle cost, in addition to bid cost. Proposed law allows the city of Lafayette, the parish of Lafayette, and the Lafayette City- Parish Consolidated Government to award public works contracts on the basis of construction time and life cycle cost, in addition to bid cost, in the same manner as the La. Dept. of Transportation and Development. Effective upon signature of governor or lapse of time for gubernatorial action.
