CONTRACTS:  Prohibits state funding of certain agreements entered into by the state
1	AN ACT
2To enact R.S. 39:1595.2, relative to the certain contractual agreements entered into by the
3 state; to prohibit the expenditure of state funds for certain agreements unless certain
4 conditions are met; to require amendment of certain contractual agreements; and to
5 provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 39:1592.2 is hereby enacted to read as follows: 
8 ยง 1595.2  Prohibition of state funds for certain contracts or agreements
9	A. For the purpose of this Section, "agreement" shall mean any of the
10 following entered into by the state:
11	(1) Contract.
12	(2)  Memorandum of understanding.
13	(3)  Cooperative endeavor agreement.
14	(4) Agreement in association with the waiver of state or federal law.
15	B. No state funds may be expended for any agreement if such agreement
16 requires the adoption of educational standards, conditions, or policies unless such
17 standards, conditions, or policies have been approved by a favorable vote of a
18 majority of the elected members of each house of the legislature if the legislature is
19 in session or by a favorable vote of a majority of the elected members of each house
20 of the legislature by mail ballot if the legislature is not in session.

1	C. Within sixty days of the effective date of this Section, no warrant shall be
2 drawn from the state treasury for the expenditure of state funds for any agreement
3 in effect that contains provisions that require the state to adopt educational standards,
4 conditions, or policies that have not been approved by the legislature in accordance
5 with Subsection B of this Section.

Abstract:  Prohibits the expenditure of state funds on certain agreements.  Requires the
amendment of agreements in effect on the effective date of proposed law to  comply
with proposed law.
Proposed law prohibits the expenditure of state funds for any agreement if such agreement
requires the state to adopt educational standards, conditions, or policies unless they have
been approved by a favorable vote of a majority of the elected members of each house of the
legislature.  For the purpose of proposed law, "agreement" means any contract,
memorandum of understanding, cooperative endeavor agreement, or in association with any
waiver of state or federal law.
Within sixty days of the effective date of proposed law, a state agency with an agreement
in effect that does not comply with the provisions of proposed law shall not draw any
warrant from the state treasury for the expenditure of state funds for the agreement.
