SCHOOLS/CHARTER:  Provides relative to charter schools
1	AN ACT
2To amend and reenact R.S. 17:3981(2) and to enact R.S. 17:3995(K), relative to charter
3 schools; to prohibit the State Board of Elementary and Secondary Education from
4 entering into proposed charters for two years; to require Type 5 charter schools
5 located in certain public school systems to pay a proportional share of the retiree
6 health care costs, including any legacy costs, of the public school system; to require
7 the State Board of Elementary and Secondary Education to promulgate rules relative
8 to such  payments; and to provide for related matters.
9Be it enacted by the Legislature of Louisiana:
10 Section 1.  R.S. 17:3981(2) is hereby amended and reenacted and R.S. 17:3995(K)
11is hereby enacted to read as follows: 
12 §3981.  State Board of Elementary and Secondary Education; powers and duties
13	relative to charter schools
14	The State Board of Elementary and Secondary Education shall:

16	(2)  Enter into any proposed charter that complies with this Chapter and the
17 rules adopted pursuant to the authority in this Chapter that the board determines is
18 a valid, complete, financially well-structured, and educationally sound proposal that
19 offers potential for fulfilling the purposes of this Chapter.  However, for the 2015-

1 2016 and 2016-2017 school years, the board shall not enter into any proposed
2 charters.

4 §3995.  Charter school funding

6	K.(1)  Notwithstanding any law, rule, regulation, or policy to the contrary,
7 in any city, parish, or other local public school system where three or more Type 5
8 charter schools are located, such charter schools shall pay a proportional share of the
9 retiree health care costs, including any legacy costs, of the public school system. 
10 The State Board of Elementary and Secondary Education shall determine the amount
11 to be paid annually and the method for making such payment by each Type 5 charter
12 school to the city, parish, or other local public school system.
13	(2)  The State Board of Elementary and Secondary Education shall
14 promulgate rules in accordance with the Administrative Procedure Act for the
15 implementation of this Subsection.

Abstract:  Prohibits BESE from entering into charters for two years and requires Type 5
charter schools located in certain school systems to pay a proportional share of the
retiree health care costs, including any legacy costs, of the public school system.
Present law (R.S. 17:3981) provides that the State Board of Elementary and Secondary
Education (BESE) shall enter into any proposed charter that complies with present law and
the rules adopted pursuant to the authority in present law that the board determines is a valid,
complete, financially well-structured, and educationally sound proposal that offers potential
for fulfilling the purposes of present law.  Proposed law prohibits the board from entering
into any such charters for the 2015-2016 and 2016-2017 school years. 
Present law (R.S. 17:3995) provides relative to funding for charter schools.  Proposed law
adds that notwithstanding any law, rule, regulation, or policy to the contrary, in any city,
parish, or other local public school system where three or more Type 5 charter schools
(Recovery School District schools)  are located, such charter schools shall pay a proportional
share of the retiree health care costs, including any legacy costs, of the public school system. 
Requires BESE to determine the amount to be paid annually and the method for making such

payment by each Type 5 charter school to the city, parish, or other local public school
