HOUSE BILL NO. 92

FIRE PROTECT/FIRE DEPTS:  Provides relative to the position of chief of training and
safety for St. Tammany Fire Protection District No. 4
1	AN ACT
2To enact R.S. 33:2541.4,  relative to St. Tammany Fire Protection District No. 4; to provide
3 relative to the municipal fire and police civil service; to provide for the position of
4 chief of training and safety, which shall be a competitive position; to provide for the
5 selection, appointment, supervision, and discharge of such position; to provide with
6 respect to qualifications for such position; to provide with respect to corrective or
7 disciplinary action relative to a person serving as the chief of safety and training; and
8 to provide for related matters.
9	Notice of intention to introduce this Act has been published
10	as provided by Article III, Section 13 of the Constitution of
11	Louisiana.
12Be it enacted by the Legislature of Louisiana:
13 Section 1.  R.S. 33:2541.4 is hereby enacted to read as follows:
14 §2541.4.  Chief of training and safety; St. Tammany Fire Protection District No. 4;
15	competitive appointment
16	A.  Notwithstanding any other provision of law to the contrary, the governing
17 authority of St. Tammany Fire Protection District No. 4 may create, by ordinance,
18 the position of chief of training and safety in accordance with the provisions of this
19 Section.  The position shall be filled on a competitive basis from a list of eligibles
20 as provided for under R.S. 33:2551, and the right of selection, appointment,

1 supervision, and discharge for such position shall be vested in the fire chief, subject
2 to approval of the district's governing authority.
3	B.(1)  The chief of training and safety shall have not less than ten years of
4 full-time fire service experience.
5	(2)  A person who holds the position of chief of training and safety may,
6 while holding such position, apply for admission to the promotional examination for
7 the class next higher than that which he held at the time of his appointment; however,
8 the name and score of any chief of training and safety shall not be certified to the
9 appointing authority by the civil service board as eligible for appointment to a
10 position of the promotional class, and his name and score shall be eligible for
11 certification, in accordance with the maximum period for which a name may remain
12 on the eligibility list in accordance with the provisions of this Part, only upon
13 demotion to a position of the class from which he was appointed as chief of training
14 and safety.
15	C.(1)  Any person who is appointed from a position in the classified fire
16 service to serve as chief of training and safety shall not forfeit his seniority and shall
17 continue to accumulate seniority in accordance with the provisions of this Part during
18 the time he holds the position of chief of training and safety.
19	(2)  If a chief of training and safety  is subjected to corrective or disciplinary
20 action, he shall have the same rights as any other employee in the municipal and
21 police civil service.

Abstract:  Provides relative to the position of chief of training and safety for St. Tammany
Fire Protection District No. 4.
Present constitution creates a fire and police civil service system applicable to municipalities
of over 13,000 in population and parishes and fire protection districts.  Provides that the
system is subject to Art. XIV, §15.1 of the 1921 constitution made statutory by the 1974
constitution.

Present law creates and provides for two fire and police civil service systems: (1) one
applicable to any municipality which operates paid police and fire departments and which
has a population of not fewer than 13,000 persons; and (2) one applicable to any parish, fire
protection district, or municipality with a population of fewer than 13,000, but not fewer
than 7,000 persons.
In both systems there are promotional and competitive positions; generally promotions are
given based on seniority, but appointing authorities have more discretion in filling
competitive positions.
Proposed law retains present law.
Proposed law authorizes the governing authority of St. Tammany Fire Protection District No.
4 to create the position of chief of training and safety.  Provides that the position shall be
filled on a competitive basis from a list of eligibles as provided for in present law. Further
requires that the right of selection, appointment, supervision, and discharge for such position
be vested in the fire chief, subject to approval of the district's governing authority.
Proposed law provides that the chief of training and safety shall have not less than 10 years
of full-time fire service experience.
Proposed law provides that a person who holds the position of chief of training and safety
may apply for a promotional examination, but he is eligible for promotion only upon
demotion to a position of the class from which he was appointed as chief of training and
safety.
Proposed law provides that a person who is appointed from a position in the classified fire
service to serve as chief of training and safety of fire department shall not forfeit his
seniority and shall continue to accumulate seniority during the time he holds the position of
chief of training and safety.
Proposed law provides that if a chief of training and safety is subjected to corrective or
disciplinary action, he shall have the same rights as any other employee in the municipal fire
and police civil service.
