HLS 15RS-378 ORIGINAL 2015 Regular Session HOUSE BILL NO. 96 BY REPRESENTATIVE SHADOIN PUBLIC LANDS/SCHOOLS: Authorizes the Union Parish School Board to exchange property 1 AN ACT 2To enact R.S. 41:909, relative to property of the Union Parish School Board; to authorize the 3 school board to exchange unused land, excluding sixteenth section land; to provide 4 for limitations and procedures; and to provide for related matters. 5 Notice of intention to introduce this Act has been published 6 as provided by Article III, Section 13 of the Constitution of 7 Louisiana. 8Be it enacted by the Legislature of Louisiana: 9 Section 1. R.S. 41:909 is hereby enacted to read as follows: 10 ยง909. Union Parish School Board; exchange of unused land 11 A. If the Union Parish School Board determines that a parcel of its property 12 in Union Parish, not including sixteenth section land, is no longer needed for school 13 purposes and that the best interest of the public school system would be served by 14 the exchange of such land for other land of comparable value, the school board may 15 exchange such land for other land in Union Parish in accordance with the procedures 16 set forth in this Section. 17 B. The Union Parish School Board shall hold a public hearing to receive 18 public comment concerning the exchange of such lands. HLS 15RS-378 ORIGINAL HB NO. 96 1 considered for exchange, and such appraisal shall be available for public inspection 2 at the hearing. 3 C. The school board shall provide notice of the public hearing and notice of 4 its intent to consider the exchange of land as well as a brief description of both 5 parcels of land by advertisement in its official journal on at least three separate days 6 at least thirty days prior to the date on which the hearing is to be held. 7 D. After such hearing and after giving due consideration to any public 8 comment, the school board may, at a regularly scheduled meeting, authorize the 9 advertised exchange if a majority of the elected membership of the school board 10 determines that the exchange is for a valid purpose and is in the best interest of the 11 school board and that the lands to be exchanged are of comparable value. The 12 president of the school board shall thereafter proceed with the exchange of the land 13 in accordance with law and upon authorization of the school board. 14 E. The powers and rights conferred by this Section shall be in addition to the 15 powers and rights conferred by any other general or special law. This Section does 16 and shall be construed to provide a complete and additional method for the exchange 17 of unused school lands, not including sixteenth section lands, by the school board. 18 No proceeding, notice, or approval shall be required for the exchange of such land 19 by the school board except as provided by this Section. The provisions of this 20 Section shall be liberally construed to accomplish its purposes. 21 Section 2. This Act shall become effective upon signature by the governor or, if not 22signed by the governor, upon expiration of the time for bills to become law without signature 23by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana. If 24vetoed by the governor and subsequently approved by the legislature, this Act shall become 25effective on the day following such approval.
