HLS 15RS-1029 ORIGINAL 2015 Regular Session HOUSE CONCURRENT RESOL UTION NO. 112 BY REPRESENTATIVE JIM MORRIS BUDGETARY CONTROL S: Reduces the expenditure limit for FY 2015-2016 1 A CONCURRENT RESOL UTION 2To direct the commissioner of administration to change the expenditure limit for Fiscal Year 3 2015-2016. 4 WHEREAS, the expenditure limit provided for in Article VII, Section 10(C)(1) of 5the Constitution of Louisiana for Fiscal Year 2015-2016 and presented to the Joint 6Legislative Committee on the Budget at its February 27, 2017, meeting is established as 7Thirteen Billion Eight Hundred Fifty-three Million Seven Hundred Sixty-Nine Thousand 8Three Hundred Two Dollars and No/100 ($13,853,769,302.00) Dollars; and 9 WHEREAS, the expenditures from Appropriations Acts and Other Requirements for 10Fiscal Year 2015-2016 proposed in the Executive Budget applicable to the expenditure limit 11are Twelve Billion Fifty-Nine Million Six Hundred Ninety-Four Thousand Seven Hundred 12Eighty-One and No/100 ($12,059,694,781.00) Dollars, or One Billion Seven Hundred 13Ninety-Four Million Seventy-Four Thousand Five Hundred Twenty-One and No/100 14($1,794,074,521.00) Dollars less than the expenditure limit, according to information 15presented to the Joint Legislative Committee on the Budget at its February 27, 2015, 16meeting; and 17 WHEREAS, HCR No. 6 of the 2013 Regular Session of the Legislature reduced the 18expenditure limit for Fiscal Year 2013-2014 from Fifteen Billion Six Hundred Eighty-Six 19Million Six Hundred Forty-Six Thousand Four Hundred Twenty-Four and No/100 20($15,686,646,424.00) Dollars to Twelve Billion Nine Hundred Sixteen Million One Hundred 21Forty Thousand Nine Hundred Fifty-Four and No/100 ($12,916,140,954.00) Dollars; and Page 1 of 3 HLS 15RS-1029 ORIGINAL HCR NO. 112 1 WHEREAS, the new expenditure limit was One Billion One Hundred Fifty-Seven 2Million Seven Hundred Twenty-Six Thousand Three Hundred Thirty and No/100 3($1,157,726,330.00) Dollars less than the Appropriation Acts and Other Requirements 4according to the state budget document; and 5 WHEREAS, reducing the expenditure limit to maintain a One Billion Two Hundred 6Million and No/100 ($1,200,000,000.00) Dollars difference between the expenditure limit 7and applicable expenditures would allow an almost ten percent increase in appropriations 8before reaching the expenditure limit; and 9 WHEREAS, Article VII, Section 10(C)(2) of the Constitution of Louisiana provides 10that the expenditure limit may be changed in any fiscal year by a favorable vote of two-thirds 11of the elected members of each house and that any such change in the expenditure limit shall 12be approved by the passage of a specific legislative instrument which clearly states the intent 13to change the limit; and 14 WHEREAS, R.S. 39:52.1 of the Louisiana Revised Statutes of 1950 provides that 15a change to the expenditure limit shall be made pursuant to a concurrent resolution adopted 16by a favorable vote of two-thirds of the elected members of each house directing the 17commissioner of administration to change the expenditure limit to a designated amount for 18a specified fiscal year. 19 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana, two-thirds of 20the elected members of each house concurring, does hereby direct the commissioner of 21administration to change the expenditure limit for Fiscal Year 2015-2016 from Thirteen 22Billion Eight Hundred Fifty-Three Million Seven Hundred Sixty-Nine Thousand Three 23Hundred Two Dollars and No/100 ($13,853,769,302.00) Dollars to Thirteen Billion Two 24Hundred Fifty-Nine Million Six Hundred Ninety-Four Thousand Seven Hundred Eighty-One 25and No/100 ($13,259,694,781.00) Dollars. 26 BE IT FURTHER RESOLVED that the provisions of this Resolution shall be 27construed to affect the expenditure limit for Fiscal Year 2016-2017 and thereafter in 28accordance with Article VII, Section 10(C) of the Constitution of Louisiana.
