ENROLLED 2015 Regular Session HOUSE CONCURRENT RESOL UTION NO. 183 BY REPRESENTATIVE HOFFMANN A CONCURRENT RESOL UTION To urge and request the office of state fire marshal to study and make recommendations with respect to the classifications, commercial implications, and inspection requirements of potable water boilers and other boilers as defined in Title 55, Part 5 of the Louisiana Administrative Code. WHEREAS, LAC 55:V:5003 defines a potable water boiler as "a vessel in which water is heated and withdrawn for use external to itself at pressures not exceeding 160 psig and temperatures not exceeding 210° F"; and WHEREAS, a potable water boiler as defined in LAC 55:V:5003 includes "hot water heaters (fired and electric), supplying potable hot water, 50 gallons and over in capacity; coil water heaters and fired jacketed kettles"; and WHEREAS, the inclusion of certain hot water heaters within the definition of potable water boiler may have implications on the plumbing industry concerning the licensing requirements for the installation and inspection of such a potable water boiler or hot water heater; and WHEREAS, the inclusion of certain hot water heaters within the definition of potable water boiler may also implicate the consumer's duty to provide inspection for such a commercial hot water heater defined by law as a potable water boiler; and WHEREAS, Title 55, Part 5 of the Louisiana Administrative Code specifies requirements for installation and inspection relative to the commercial use of potable water boilers, hot water heaters, and other devices defined as boilers; and WHEREAS, LAC 55:V:5007 provides that "upon completion of installation, all boilers shall be inspected by an inspector commissioned to inspect boilers in this state"; and WHEREAS, the rules and regulations made applicable to inspectors commissioned to inspect boilers in this state are under the purview of the office of state fire marshal, as are Page 1 of 2 HCR NO. 183 ENROLLED the provisions of law made applicable to all boilers as defined in Title 55, Part 5 of the Louisiana Administrative Code; and WHEREAS, it reasonably follows that the office of state fire marshal is the appropriate agency to study and make recommendations relative to boilers in this state, and the findings and recommendations from such a study may help to determine revisions necessary to properly govern any potable water boiler, hot water heater, or other device defined as a boiler in Title 55, Part 5 of the Louisiana Administrative Code. THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby urge and request the office of state fire marshal to study and make recommendations with respect to the classifications, commercial implications, and inspection requirements of potable water boilers and other boilers as defined in Title 55, Part 5 of the Louisiana Administrative Code. BE IT FURTHER RESOLVED that the office of state fire marshal may also evaluate consensus standards and may make maintenance recommendations with respect to its findings relative to any boiler as defined in Title 55, Part 5 of the Louisiana Administrative Code. BE IT FURTHER RESOLVED that the office of state fire marshal shall report its findings and recommendations to the House Committee on Commerce and Senate Committee on Commerce, Consumer Protection, and International Affairs on or before February 15, 2016. BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to Chief H. "Butch" Browning and Deputy Chief Brant L. Thompson of the office of state fire marshal.
