1	AN ACT
2 To enact R.S. 40:1299.48(D), relative to reporting of paid malpractice claims; to provide for
3 annual reporting to legislative committees; to provide for an effective date; and to
4 provide for related matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 40:1299.48(D) is hereby enacted to read as follows: 
7 ยง1299.48.  Reporting of claims

9	D.(1) The executive director of the Patient's Compensation Fund shall
10 submit a report on an annual basis to the Senate and House committees on
11 health and welfare no later than January thirty-first.  The report shall contain
12 every claim against an individual practitioner who has had five or more paid
13 claims for the previous year paid by the Patient's Compensation Fund and shall
14 contain the following information:
15	(a) All paid claims for the previous year and the year immediately
16 preceding that year, as well as the total number of pending claims filed against
17 that individual practitioner.
18	(b) The name and address of the individual practitioner and a brief
19 description of the acts of omission or commission which gave rise to the paid
20 claims.
21	(2)  For the purposes of this Subsection, "individual practitioner" means
22 any individual person licensed or certified by this state to provide health care
23 or professional services who is listed in R.S. 40:1299.41(A)(10).

1 Section 2.  This Act shall become effective upon signature by the governor or, if not
2 signed by the governor, upon expiration of the time for bills to become law without signature
3 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
4 vetoed by the governor and subsequently approved by the legislature, this Act shall become
5 effective on the day following such approval.
