HLS 16RS-77 ORIGINAL 2016 Regular Session HOUSE BILL NO. 101 BY REPRESENTATIVE NORTON CRIME: Creates the crime of operation of an unsafe motion picture theater 1 AN ACT 2To enact R.S. 14:95.11, relative to offenses affecting public safety; to create the crime of 3 unlawful operation of an unsafe motion picture theater; to provide definitions; to 4 provide criminal penalties; and to provide for related matters. 5Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 14:95.11 is hereby enacted to read as follows: 7 ยง95.11. Operation of an unsafe motion picture theater 8 A. On or after January 1, 2017, a person who is an owner or operator of a 9 motion picture theater in the state of Louisiana shall install in each motion picture 10 theater he owns or operates a walk-through metal detector, a wand metal detector, 11 or equivalent electronic equipment designed to detect the presence of firearms and 12 other dangerous weapons in the possession of theater patrons, and shall require that 13 each patron be scanned for the presence of firearms or dangerous weapons in their 14 possession prior to entering the motion picture theater. 15 B. For the purposes of this Section: 16 (1) "Motion picture" means a nationally or internationally distributed 17 feature-length film, short film, video, or documentary for theatrical viewing. 18 (2) "Motion picture theater" means a movie theater, which is open to the 19 public and typically charges admission for the exhibition of a motion picture. Whoever violates the provisions of this Section, by either failing to install 4 the equipment or failing to scan patrons as required by the provisions of Subsection 5 A of this Section, shall be fined not more than five hundred dollars for the first 6 offense and not more than one thousand dollars for a second or subsequent offense. 7 Each day of operation shall be considered a separate offense. Proposed law creates the crime of operation of an unsafe motion picture theater. Requires the installation of metal detectors to detect the presence of weapons, and requires that each patron be scanned for weapons prior to entering the theater. Proposed law provides penalties of not more than $500 for a first offense and not more than $1,000 for a second or subsequent offense. Proposed law provides that each day of operation shall constitute a separate offense.
