HOUSE BILL NO. 1132

MTR VEHICLE/VIOLATIONS:  Increases penalties for moving violations when children
are present in the vehicle at the time of the violation
1	AN ACT
2To enact R.S. 32:123(E)(1)(d)(iii) and 300.5(C)(5), relative to fines imposed for violations
3 of traffic laws; to increase fines for moving violations when children are present in
4 the vehicle; to provide for penalties for multiple offenses; and to provide for related
5 matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S.32:123(E)(1)(d)(iii) and 300.5(C)(5) are hereby enacted to read as
8follows:
9 §123.  Stop signs and yield signs; penalties for violations

15	(iii)  If the violation occurs when a child under the age of fourteen is present
16 in the vehicle then the fine imposed shall be quadrupled. If a subsequent violation
17 occurs within five years when a child under the age of fourteen is present in the
18 vehicle then the fine imposed shall be quadrupled and the offender shall complete
19 thirty days of community service.

8	(b)  If a subsequent violation occurs within five years when a child under the
9 age of fourteen is present in the vehicle then the fine imposed shall be quadrupled
10 and the offender shall complete thirty days of community service.
