HOUSE BILL NO. 22
BY REPRESENTATIVES MONTOUCET AND REYNOL DS
1	AN ACT
2 To amend and reenact R.S. 11:107.1(B)(2) and (D)(4)(a) and 107.2(A) and (B)(introductory
3 paragraph) and to enact R.S. 11:105(A)(7), 107(A)(6), 107.1(A)(6) and (D)(4)(c),
4 relative to the Firefighters' Retirement System; to provide relative to the authority
5 of the board of trustees of the system to modify employer contribution rates in
6 certain circumstances; to establish a funding deposit account within the system; and
7 to provide for related matters.
8	Notice of intention to introduce this Act has been published
9	as provided by Article X, Section 29(C) of the Constitution
10	of Louisiana.
11 Be it enacted by the Legislature of Louisiana:
12 Section 1.  R.S. 11:107.1(B)(2) and (D)(4)(a) and 107.2(A) and (B)(introductory
13 paragraph) are hereby amended and reenacted and R.S. 11:105(A)(7), 107(A)(6) ,
14 107.1(A)(6) and (D)(4)(c) are hereby enacted to read as follows: 
15 §105.  Employer contributions; maintaining rates
16	A.  The provisions of this Section shall apply to the following statewide
17 public retirement systems or funds, hereinafter referred to in this Section as
18 "systems":

1 §107.  Additional employer contributions; reducing rate decreases
2	A.  The provisions of this Section shall apply to the following statewide
3 public retirement systems or funds:

5	(6)  The Firefighters' Retirement System.

7 §107.1.  Funding deposit account
8	A.  The provisions of this Section shall apply to the following statewide
9 public retirement systems or funds, hereinafter referred to in this Section as
10 "systems":

12	(6)  The Firefighters' Retirement System.

15	(2)  The balance in the account shall be set equal to zero as of December 31
16 ,2008 thirty-first of the year immediately preceding the date the account is
17 established.

19	D.  Notwithstanding any provisions of law to the contrary, the board of
20 trustees of each system may in any fiscal year direct that funds from the account be
21 charged for the following purposes:

23	(4)(a)  To Except as provided in Subparagraph (c) of this Paragraph, to
24 provide for cost-of-living increases, in accordance with applicable law.

26	(c)  Notwithstanding any provision of law to the contrary, the Firefighters'
27 Retirement System shall not provide for cost-of-living increases with funds charged 
28 from the account.

2	Firefighters' Retirement System; Municipal Police Employees' Retirement
3	System
4	A.  The provisions of this Section apply to the following statewide public
5 retirement systems or funds, hereinafter referred to in this Section as "systems":
6	(1)  The Firefighters' Retirement System.
7	(2)  The the Municipal Police Employees' Retirement System, hereinafter
8 referred to in this Section as "system".
9	B.  Notwithstanding the provisions of R.S. 11:103 and 104, in any fiscal year
10 during which the recommended net direct employer contribution rate would
11 otherwise be decreased for any the system, the board of trustees of the system is
12 hereby authorized to either:

14 Section 2.  This Act shall become effective on July 1, 2016; if vetoed by the governor
15 and subsequently approved by the legislature, this Act shall become effective on July 1,
16 2016, or on the day following such approval by the legislature, whichever is later.
