[R.S. 1:13(B) and 24:177(E)] HB 221 Original 2016 Regular Session Hunter Abstract: Removes the prohibition on the receipt of workers' compensation benefits while incarcerated. Present law requires a forfeiture of workers' comp benefits while incarcerated, except in certain circumstances. Present law provides that if the incarcerated injured worker has a dependent who relies on the compensation for support, a workers' compensation judge may order that the benefits are paid to the dependent's guardian. Present law allows for the payment of medical expenses incurred when an employee has been assigned to work release or a transitional work program and is injured during his participation in such program. Present law provides that the injured employee is eligible to resume collection of workers' compensation benefits upon his release. Proposed law removes the requirement of forfeiture of workers' compensation benefits while incarcerated. (Repeals R.S. 23:1201.4) Page 1 of 1
