HOUSE BILL NO. 278

HUNTING:  Provide for the taking of outlaw quadrupeds
1	AN ACT
2To amend and reenact R.S. 56:116.1(D)(2) and to enact R.S. 56:112(C), relative to hunting;
3 to provide for taking certain outlaw quadrupeds, nutria, or beaver during certain
4 times; to provide for certain permits and licenses; to provide for notice; and to
5 provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 56:116.1(D)(2) is hereby amended and reenacted and R.S. 56:112(C)
8is hereby enacted to read as follows:
9 §112.  Disposal of birds or quadrupeds becoming a nuisance

11	C.  Any permit or license issued or authority given pursuant to this Section
12 authorizing the taking of depredating outlaw quadrupeds shall be valid for an
13 undetermined term, but shall be revoked or suspended upon conviction of the holder
14 of a violation of any provision of Part IV or Part V of this Chapter.

1	(2)  On private property, the landowner, or his lessee or agent with written
2 permission and the landowner's contact information in his possession, may take
3 outlaw quadrupeds, nutria, or beaver during nighttime hours from one-half hour after
4 official sunset on the last day of February to one-half hour after official sunset the
5 last day of August of that same year.  Such taking may be with or without the aid of
6 artificial light, infrared or laser sighting devices, or night vision devices.  Any person
7 attempting to take outlaw quadrupeds under the provisions of this Paragraph, within
8 twenty-four hours prior to the attempted taking, shall notify the sheriff of the parish
9 in which the property is located of his intention to attempt to take outlaw quadrupeds
10 under the provisions of this Paragraph.

Abstract:  Provides for permits, licenses, authorities, and notifications required to take
certain outlaw quadrupeds.
Present law authorizes the secretary of the Dept. of Wildlife and Fisheries to direct any
enforcement agent or reputable citizen of this state to take and dispose of wild birds or wild
quadrupeds that have been so destructive to private property as to be a nuisance.  Proposed
law retains present law.
Present law authorizes the La. Wildlife and Fisheries Commission to promulgate rules and
regulations to permit taking and disposal of such wild birds or wild quadrupeds.  Any person
authorized to take any outlaw quadruped or outlaw bird under present law shall be exempt
from obtaining any other permits or licenses while engaged in taking such animals and may
do so by use of aircraft. The rules shall prohibit the sale of any part of the animal.
Proposed law requires that any permit license issued or authority given pursuant to present
law authorizing the taking of depredating outlaw quadrupeds shall be valid for an
undetermined term.  However, the permit, license, or authority shall be revoked upon
conviction of any hunting or trapping violation.
Present law allows taking of outlaw quadrupeds, nutria, and beaver on private property at
night by the landowner or lessee or agent with written permission and the landowner's
contact information on his person.  Such taking is limited to the period of time from the last
day of Feb. to the last day of Aug. each year.  Taking may be with or without the aid of
artificial light, infrared or laser sighting devices, or night vision devices.  Proposed law
retains present law.

Present law requires notification to the sheriff by any person attempting to take outlaw
quadrupeds on private property at night within 24 hours prior to the attempted taking.
Proposed law retains the notification requirement, but removes the requirement that the
notification be within 24 hours prior to the attempted taking.
