HOUSE BILL NO. 354
BY REPRESENTATIVE JENKINS
ETHICS:  Allows a public servant to accept admission, lodging, and transportation to and
from certain events while serving as director of a national or regional nonprofit
professional public procurement association
1	AN ACT
2To enact R.S. 42:1123(44), relative to the acceptance of certain admission, lodging, and
3 transportation by public servants; to provide an ethics exception to allow such
4 acceptance related to certain events; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 42:1123(44) is hereby enacted to read as follows: 
7 §1123.  Exceptions
8	This Part shall not preclude:

10	(44)(a)  The acceptance by a public servant, while serving in the capacity of
11 director of a national or regional nonprofit professional public procurement
12 association, of complimentary admission to, lodging reasonably related to, and
13 reasonable transportation to and from a seminar, conference, board meeting,
14 committee meeting, or public event held in any state of the United States or in
15 Canada, provided that the seminar, conference, board meeting, committee meeting,
16 or public event is related to the public servant's duties of serving as director of such
17 a procurement association.
18	(b)  Any public servant who accepts complimentary admission, lodging, or
19 transportation pursuant to this Paragraph shall file an affidavit with the Board of

1 Ethics, within sixty days after such acceptance, disclosing (i) the name of the person
2 or organization who gave, provided, or paid in whole or in part for the admission,
3 lodging, or transportation, (ii) the person or organization that hosted the seminar,
4 conference, board meeting, committee meeting, or public event, and (iii) the amount
5 expended on his behalf by the person or organization on admission, lodging, and
6 transportation.
7 Section 2.  This Act shall become effective upon signature by the governor or, if not
8signed by the governor, upon expiration of the time for bills to become law without signature
9by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
10vetoed by the governor and subsequently approved by the legislature, this Act shall become
11effective on the day following such approval.

Abstract: Allows a public servant, while serving in the capacity of director for a national
or regional nonprofit professional public procurement association, to accept specified
event and travel expenses to attend certain events related to the duties of serving as
director of such a procurement association.
Present law (R.S. 42:1111 and 1115 – ethics code) prohibits public servants from receiving
things of economic value from certain prohibited sources or for certain duties or because of
the public position held. Present law (R.S. 42:1123) provides certain specified exceptions.
Proposed law provides an exception to allow a public servant, while serving in the capacity
of director for a national or regional nonprofit professional public procurement association,
to accept complimentary admission to, lodging reasonably related to, and reasonable
transportation to and from a seminar, conference, board meeting, committee meeting, or
public event held in any state of the U.S. or in Canada, provided that the seminar,
conference, board meeting, committee meeting, or public event related to the duties of
serving as director of such a procurement association.  Proposed law further requires the 
public servant to file an affidavit with the Board of Ethics within 60 days after such
acceptance, disclosing the name of the person or organization who gave, provided, or paid
in whole or in part for the admission, lodging, or transportation; the person or organization
that hosted the event; and the amount expended on his behalf by the person or organization
on admission, lodging, and transportation.
Effective upon signature of governor or lapse of time for gubernatorial action.
