HOUSE BILL NO. 384

ALCOHOLIC BEVERAGE PERMT:  Provides relative to information contained in
alcoholic beverage permits
1	AN ACT
2To amend and reenact R.S. 26:282 and to enact R.S. 26:80.1, relative to alcoholic beverage
3 permits; to provide relative to permit applications; and to provide for related matters.
4Be it enacted by the Legislature of Louisiana:
5 Section 1.  R.S. 26:282 is amended and reenacted and R.S. 26:80.1 is hereby enacted
6and to read as follows: 
7 §80.1.  Misstatement or suppression of fact in application
8	Any misstatement or suppression of fact in an application or accompanying
9 affidavit is a ground for the denial, withholding, or suspension of a permit in the
10 manner provided in this Chapter, and may also include the filing of criminal charges.

Abstract:  Adds criminal charges as possible penalty for misstatements or suppression of
facts in applications for alcoholic beverage permits.
Present law provides that the misstating or suppressing of facts in applications for an
alcoholic beverage permit may result in the denial, withholding, or suspending of the permit,
but does not provide the possibility of criminal charges. 
Proposed law adds the filing of criminal charges in addition to the denial, withholding, or
suspending of an alcoholic beverage permit if an applicant misstates facts or suppresses facts
in the application process.
