HOUSE BILL NO. 436

HEALTH CARE/FACILITIES:  Provides relative to application of ambulatory surgical
center regulations to certain nonsurgical procedures
1	AN ACT
2To enact R.S. 40:2136(D), relative to health standards for ambulatory surgical centers; to
3 provide for regulation of certain nonsurgical procedures performed at ambulatory
4 surgical centers; to provide relative to the staffing pattern for nonsurgical endoscopy
5 procedures; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 40:2136(D) is hereby enacted to read as follows: 
8 ยง2136.  Rules; regulations; minimum standards

10	D.  Notwithstanding any provision of this Chapter to the contrary, no rule,
11 regulation, or minimum standard promulgated pursuant to this Section shall require
12 a staffing pattern for nonsurgical endoscopy procedures performed at an ambulatory
13 surgical center to exceed the staffing pattern for such procedures recommended by
14 the American Society for Gastrointestinal Endoscopy.

Abstract:  Provides for regulation of nonsurgical endoscopy procedures performed at
ambulatory surgical centers.
Present law provides for licensure and regulation of ambulatory surgical centers.  Proposed
law retains present law.
Proposed law provides that notwithstanding any provision of present law to the contrary, no
rule, regulation, or minimum standard promulgated pursuant to present law shall require a
staffing pattern for nonsurgical endoscopy procedures performed at an ambulatory surgical
center to exceed the staffing pattern for such procedures recommended by the American
Society for Gastrointestinal Endoscopy.
