HOUSE BILL NO. 446

FEES/LICENSES/PERMITS:  Establishes an application fee for a new marijuana pharmacy
permit and limits eligibility for the permit
1	AN ACT
2To enact R.S. 37:1184(3)(k), relative to medical marijuana pharmacy permits; to authorize
3 an application fee for a new marijuana pharmacy permit; to provide for the amount
4 of the fee; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 37:1184(3)(k) is hereby enacted to read as follows: 
7 ยง1184.  Fees
8	Notwithstanding any other provision of this Chapter, the fees and costs
9 established by the board in accordance with R.S. 37:1182(A) shall not be less than
10 the following schedule:
11	Minimum

13 (3)Licenses, permits, certification, registration, and
14	any other designations for pharmacy locations

16	(k)Application fee for new marijuana pharmacy permit$5,000.00
17	No current member of the Louisiana Board of Pharmacy or his immediate
18 family as defined in R.S. 42:1102(13) shall be eligible to apply for a new marijuana
19 permit. Furthermore, no person who was a member of the Louisiana Board of

1 Pharmacy or his immediate family as defined in R.S. 42:1102(13) may apply for a
2 new marijuana permit within two years of the last day of his term on the board.

Abstract:  Authorizes the La. Board of Pharmacy to collect an application fee for a new
marijuana pharmacy permit and limits eligibility for the permit.
Present law establishes the schedule of minimum amounts for fees to be collected by the La.
Board of Pharmacy.
Proposed law retains present law and adds a new marijuana pharmacy permit application fee
with a minimum amount of $5000.
Proposed law prohibits a current member of the La. Board of Pharmacy or his immediate
family from applying for a new marijuana permit. Further prohibits a person who was a
member of the La. Board of Pharmacy or his immediate family from applying for a new
marijuana permit within two years of the last day of his term on the board.
