ENROLLED ACT No. 435 2016 Regular Session HOUSE BILL NO. 464 BY REPRESENTATIVE BISHOP 1 AN ACT 2 To amend and reenact R.S. 30:560(B) and (C) and 706 and to enact R.S. 30:560(D), relative 3 to pipelines; to provide relative to pipeline safety inspection fees for certain 4 pipelines; to provide relative to the amounts and imposition of such fees; and to 5 provide for related matters. 6 Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 30:560(B) and (C) and 706 are hereby amended and reenacted and 8 R.S. 30:560(D) is hereby enacted to read as follows: 9 §560. Pipeline safety inspection fees 10 * * * 11 B. There is hereby imposed upon all distributors of jurisdictional gas which 12 who own and operate any jurisdictional gas distribution system which that comes 13 under the supervision of the assistant secretary pursuant to R.S. 30:551(B) an annual 14 safety and odorization inspection fee not to exceed twenty-two dollars and forty 15 cents per mile of pipeline used in a jurisdictional gas distribution system one dollar 16 per service line, or four hundred dollars per pipeline facility, whichever is greater. 17 The commissioner shall annually review the fee amount and may revise it in 18 accordance with the Administrative Procedure Act. 19 C. There is hereby imposed upon all distributors of jurisdictional gas who 20 own or operate any jurisdictional gas gathering or transmission system that comes 21 under the supervision of the assistant secretary pursuant to R.S. 30:551(B) an annual 22 safety inspection fee not to exceed forty-four dollars and eighty cents per mile of 23 pipeline used in a jurisdictional gas pipeline system, or eight hundred dollars per Page 1 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HB NO. 464 ENROLLED 1 pipeline facility, whichever is greater. The commissioner shall annually review the 2 fee amount and may revise it in accordance with the Administrative Procedure Act. 3 D. The annual inspection fees imposed by this Section are for the purpose 4 of enforcing the natural gas pipeline safety standards and practice required by this 5 Chapter and regulations promulgated thereunder. All fees collected by the 6 commissioner shall be reasonably related to the services provided and shall be used 7 by the office of conservation solely for the purposes of that program. 8 * * * 9 §706. Fees 10 In order to implement this Part, every person engaged in the transportation 11 of hazardous liquids or who owns or operates intrastate pipeline facilities for the 12 transportation of hazardous liquids shall be assessed an annual fee which shall not 13 exceed twenty-two dollars and forty cents forty-four dollars and eighty cents for each 14 mile or fraction thereof of pipeline operated or four eight hundred dollars per 15 pipeline facility, whichever is greater. The commissioner shall annually review the 16 fee amount and may revise it not to exceed twenty-two dollars and forty cents forty- 17 four dollars and eighty cents per mile in accordance with the Administrative 18 Procedure Act. All fees collected by the commissioner shall be reasonably related 19 to the services provided and shall be used by the office of conservation solely for the 20 purposes of that program.
