HLS 16RS-1089 ORIGINAL 2016 Regular Session HOUSE BILL NO. 489 BY REPRESENTATIVE NANCY LANDRY HEALTH/CANCER: Provides for access by patients to mammography and ultrasound reports 1 AN ACT 2To amend and reenact R.S. 40:1211.3(A) and (B) and 1211.4(A)(introductory paragraph), 3 relative to mammography and ultrasound results; to require mammography results 4 to be sent to the patient; to require a full mammography report to be sent to the 5 patient's physician; to authorize delivery by hand; to provide for transmittal of 6 certain information to patients upon request; to provide for related matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 40:1211.3(A) and (B) and 1211.4(A)(introductory paragraph) are 9hereby amended and reenacted to read as follows: 10 §1211.3. Notice concerning supplemental screening 11 A. Upon completion of any screening mammogram, regardless of whether 12 the mammogram was directed by prescription of a licensed practitioner, each 13 mammography facility certified by the United States Food and Drug Administration 14 or by a certification agency approved by the United States Food and Drug 15 Administration shall mail to the patient, in addition to any letter or report required 16 by 21 CFR Part 900, the following notice in conspicuous and legible type which is 17 not smaller than twelve-point font: 18 "If your mammogram demonstrates that you have dense breast tissue, which 19 could hide abnormalities, and you have other risk factors for breast cancer that have Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 16RS-1089 ORIGINAL HB NO. 489 1 been identified, you might benefit from supplemental screening tests that may be 2 suggested by your ordering physician. 3 Dense breast tissue, in and of itself, is a relatively common condition. 4 Therefore, this information is not provided to cause undue concern, but rather to 5 raise your awareness and to promote discussion with your physician regarding the 6 presence of other risk factors, in addition to dense breast tissue. 7 A summary of your Your mammography results will be sent to you, and a 8 full mammography report will be sent to your physician and also to you. You should 9 contact your physician if you have any questions or concerns regarding your 10 summary or report of results." 11 B. The notice provided for in this Section may be transmitted to the patient 12 by either regular mail or certified mail via the United States Postal Service, or by any 13 other commercial mail delivery service, or it may be delivered in person by hand. 14 * * * 15 §1211.4. Mammography and ultrasound reports; transmittal to patients required 16 A. Each mammography facility certified by the United States Food and Drug 17 Administration or by a certification agency approved by the United States Food and 18 Drug Administration and every healthcare facility that performs breast ultrasound 19 examinations shall transmit to each mammography and ultrasound patient upon the 20 patient's request the following, as appropriate to the procedure performed: 21 * * * DIGEST The digest printed below was prepared by House Legislative Services. Present law requires a summary of mammography results to be sent to the patient and a full mammography report to be sent to both the physician and the patient. Proposed law changes the mandate so that a full mammography report shall only be sent to the patient upon request. S. Postal Service or by any other commercial mail delivery service. Proposed law retains present law and further authorizes delivery in person by hand. Present law requires an ultrasound report to be transmitted to the patient. Proposed law repeals the mandate and only requires an ultrasound report be sent to the patient upon request.
