HOUSE BILL NO. 502
BY REPRESENTATIVE SMITH
SCHOOLS/CHARTER:  Requires the State Bd. of Elementary and Secondary Education to
conduct a fiscal impact study prior to making a determination relative to a Type 2
charter school proposal
1	AN ACT
2To amend and reenact R.S. 17:3983(A)(3)(b), relative to charter schools; to require the State
3 Board of Elementary and Secondary Education to study, prior to its approval of
4 proposals for certain types of charter schools, the fiscal impact the charter school
5 would have on the local public school district; to require the state board to publish
6 the study and to allow testimony pertaining to the study at a public meeting; and to
7 provide for related matters.
8Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 17:3983(A)(3)(b) is hereby amended and reenacted to read as follows:

16	(b)  For Type 2 charter school proposals, the state board shall notify the local
17 school board of the district in which the proposed charter school is to be located
18 about the receipt of such proposal. Prior to any determination by the state board
19 relative to the proposal, each of the following shall occur:

1	(i)  The state board shall prepare and publish on its website a fiscal impact
2 study that analyzes the fiscal impact such proposed charter school would have on the
3 local school district.
4	(ii)  The state board shall allow the  The local board, as well as other

6 regarding the proposal and the fiscal impact study and allowed to present information
7 and testimony on the proposal and study at a scheduled public meeting of the state
8 board prior to any determination being made by the state board.

Abstract:  Requires the State Bd. of Elementary and Secondary Education to prepare, post
on its website, and allow public testimony pertaining to a fiscal impact study prior
to making a determination relative to a Type 2 charter school proposal.
Present law defines seven types of charter schools and provides a chartering process for each
type. Provides that a Type 2 charter school is a new or preexisting public school operated
pursuant to a charter between a nonprofit corporation and the State Bd. of Elementary and
Secondary Education (BESE). Relative to proposals for Type 2 charter schools, present law
requires BESE to notify the local school board of the district in which the proposed charter
school would be located about the receipt of such proposal. Proposed law retains present
law.
Present law requires that the local school board and other interested groups be allowed to
provide written information regarding the proposal and present information at a scheduled
public BESE meeting prior to any BESE determination.
Proposed law requires BESE, prior to a determination relative to a Type 2 charter proposal,
to do each of the following:
(1)Prepare and publish on its website a fiscal impact study relative to the fiscal impact
such proposed charter school would have on the local school district. 
(2) Allow groups and individuals to provide written information and testimony on both
the proposal and the study, at a public BESE meeting.
