WATER/RESOURCES:  Requires permits for certain ground water users
1	AN ACT
2To enact R.S. 38:3097.3(C)(11), relative to water management; to provide for the authority
3 of the commissioner of conservation; to provide for permitting certain users of
4 ground water; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 38:3097.3(C)(11) is hereby enacted to read as follows:
7 ยง3097.3.  Commissioner of conservation; powers and duties

9	C.  The commissioner has authority to make, after notice and public hearings
10 in accordance with the Administrative Procedure Act, any reasonable rules,
11 regulations, and orders that are necessary from time to time in the proper
12 administration and enforcement of this Chapter, including rules, regulations, or
13 orders for the following purposes:

15	(11)  Establish a permit for industrial users of ground water that withdraw
16 greater than one hundred thousand gallons of ground water per day and require each
17 such user to obtain a permit.

Abstract:  Requires permitting of industrial users that withdraw greater than 100,000
gallons per day.
Present law requires the commissioner, through the office of conservation, to administer all
matters related to the management of the state's ground water resources by providing for the
most "advantageous use" of the resource consistent with the protection, conservation, and
replenishment thereof.
Proposed law authorizes the commissioner to make rules, regulations, or orders to establish
and require a permit of industrial users that withdraw greater than 100,000 gallons per day.
